All that portion lying Southwest of 100th Street Southwest in the <br /> following described parcel: <br /> Commencing at the Northwest Corner of the Northeast one-quarter <br /> (1/4) of the Northwest one-quarter (1/4) of the Northeast <br /> one-quarter (1/4) of Section 24, Township 28 North, Range 4 East, <br /> W.M. : thence North 89 degrees 57 minutes 22 seconds East along <br /> the North line of said subdivision for 170.00 feet; thence South <br /> 00 degrees 05 minutes 54 seconds East for 135.53 feet; thence <br /> South 89 degrees 57 minutes 22 seconds West for 170.00 feet; <br /> thence North 00 degrees 05 minutes 54 seconds West for 135.53 <br /> feet to the point of beginning. <br /> Section 4: That this ordinance shall not become effective until the <br /> owners of the property abutting upon the street herein described have <br /> compensated the City of Everett in an amount equal to the difference of <br /> one-half the current appraised value of the area herein described in <br /> Section 1 and one-half the current appraised value of the area herein <br /> above described in Section 3. The abutting property owners shall have <br /> ninety (90) days following passage of this ordinance to exercise this <br /> vacation. Unless otherwise amended by City Council, this ordinance shall <br /> be null and void if the abutting property owner(s) fail to exercise this <br /> vacation within ninety (90) days following passage of this ordinance. <br /> Section 5: This vacation (L.I.D. 724) is subject to an L.I.D. <br /> assessment for the improvement of 100th Street S.W. This assessment runs <br /> with the land and is assumed and agreed to be paid by the <br /> petitioner/proponent/owner. <br /> Section 6: That all monies derived from the sale of the <br /> above-described right-of-way vacation shall be deposited in the "Real <br /> Property Acquisition Fund.
