• <br /> 1 <br /> D. Occupying or Renting Vacant Buildings. <br /> 2 <br /> After a notice of violation, order or emergency order is <br /> 3 issued in accordance with the provisions of this code, no one <br /> shall use, occupy, rent, cause, suffer, or allow any person to <br /> 4 use or occupy or rent any vacant building that has been vacated, <br /> after issuance of a notice of violation, order or emergency <br /> 5 order, unless written approval from the Building Official has <br /> been obtained. <br /> 6 <br /> 7 Section 4: Third Party Liability. <br /> 8 It is expressly the purpose of this ordinance to provide for and <br /> 9 promote the health, safety and welfare of the general public and not to <br /> 10 create or otherwise establish or designate any particular class or group of <br /> 11 persons who will or should be especially protected or benefited by the terms <br /> 12 of this ordinance. <br /> 13 It is the specific intent of this ordinance to place the obligation of <br /> 14 complying with its requirements upon the property owner(s) and no provisions <br /> 15 nor term used in this ordinance is intended to impose any duty whatsoever <br /> 16 upon the City or any of its officers or employees, for whom the <br /> 17 implementation and enforcement of this ordinance shall be discretionary and <br /> 18 not mandatory. <br /> 19 Nothing contained in this ordinance is intended to be nor shall be <br /> 20 construed to create or form the basis for any liability on the part of the <br /> 21 City, or its officers, employees or agents, for any injury or damage <br /> 22 resulting from the failure of a property to comply with the provisions of <br /> 23 this ordinance, or by reason or in consequence of any inspection, notice, <br /> 24 order, certificate, permission or approval authorized or issued or done in <br /> 25 connection with the implementation or enforcement of this ordinance, or by <br /> 26 reason of any action or inaction on the part of the City related in any <br /> 27 manner to the enforcement of this ordinance by its officers, employees or <br /> 28 agents. <br /> 29 Section 5: Severability. <br /> 30 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 31 of this ordinance or its application to any person or situation be declared <br /> 32 <br /> 5 <br />
