1 ORDINANCE NO. 1717-90 2 3 AN ORDINANCE authorizing use of the electronic speed monitoring device and the mailing of an informational letter 4 requesting compliance to the posted speed limits. 5 6 WHEREAS, the City Council finds that public safety is promoted by high 7 visibility of traffic ordinance enforcement; and 8 WHEREAS, various volunteer groups have offered to operate the 9 electronic speed monitoring device which registers vehicle speeds, the 10 volunteer groups will record vehicle licenses of vehicles appreciably 11 exceeding the posted speed limit and an informational letter will be sent to 12 the registered owner advising the owner of the time, place and speed 13 recorded, and emphasizing the importance of driving at the posted speed 14 limit; and 15 WHEREAS, the City Council wishes to establish conditions of use of the 16 electronic speed monitoring device by persons other than City employees; 17 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 18 Section 1 : The Public Works Director, or his designee, is hereby 19 authorized to establish conditions for use of the electronic speed 20 monitoring device by persons other than City employees which shall include 21 the following minimum conditions: 22 1 . Said device shall be available to local service groups or 23 organizations; 24 2. Said device shall be not be used outside the Everett City limits; and 25 3. Said organizations shall execute a consent and release 26 substantially in the following form: 27 AGREEMENT FOR USE OF ELECTRONIC SPEED MONITORING DEVICE 28 The undersigned person represents that he is an 29 authorized representative of and does hereby request the City of Everett to grant to the 30 undersigned organization the right to use the electronic speed monitoring device belonging to the City of Everett, 31 for the purpose of encouraging speed reduction and traffic safety in the City of Everett.
