1 Section 3: Severability. 2 Should any section, subsection, paragraph, sentence, clause, or phrase 3 of this ordinance or its application to any person or situation be declared 4 unconstitutional or invalid for any reason, such decision shall not affect 5 the validity of the remaining portions of this ordinance or its application 6 to any other person or situation. The City Council of the City of Everett 7 hereby declares that it would have adopted this ordinance and each section, 8 subsection, sentence, clause, phrase or portion thereof irrespective of the 9 fact that any one or more sections, subsections, sentences, clauses, phrases 10 or portions be declared invalid or unconstitutional . 11 Section 4: Third Party Liability. 12 It is expressly the purpose of this ordinance to provide for and 13 promote the health , safety and welfare of the general public and not to 14 create or otherwise establish or designate any particular class or groups of 15 persons who will or should be especially protected or benefitted by the 16 terms of this ordinance. 17 It is the specific intent of this ordinance that no provisions nor any 18 term used in this ordinance is intended to impose any duty whatsoever upon 19 the City or any of its officers or employees, for whom the implementation 20 and enforcement of this ordinance shall be discretionary and not mandatory. 21 Nothing contained in this ordinance is intended nor shall be construed 22 to create or form the basis of any liability on the part of the City, or its 23 officers, employees or agents, for any injury or damage resulting from any 24 action or inaction on the part of the City related in any manner to the 25 enforcement of this ordinance by its offii s employees or agents. 26 277:1-r PETE ‘'r"-",1, 'ayor 28 ;29 ‹,6i7 :2;:;/ 4!?4/_, ATTEST: ) CITY CLERK 31 Passed: 4-/2/90 32 Valid: .5/3/90 Published: 5/9/90 (0091 ) 3
