I'. <br /> 1A <br /> ORDINANCE NO. /68.,s_90 <br /> AN ORDINANCE creating a special construction <br /> fund entitled "Jetty Island Dock Facilities" <br /> Fund 352, Authorizing the design and <br /> construction of improvements at Jetty Island. <br /> WHEREAS, a need exists to provide improved facilities for the citizens of <br /> Everett using Jetty Island; and <br /> WHEREAS, the City Council authorized the City to enter into an agreement <br /> with the Port of Everett and the Interagency Committee for Outdoor Recreation <br /> to fund improvements at Jetty Island; and <br /> WHEREAS, the Everett City Council allocated $150,000 general fund <br /> contribution as matching funds for this grant; and <br /> WHEREAS, in November 1989 the grant was awarded to the City of Everett by <br /> the Interagency Committee for Outdoor Recreation; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE EVERETT CITY COUNCIL THAT: <br /> Section 1: A special construction fund is hereby established as Fund 352, <br /> entitled "Jetty Island Dock Facilities" to accomplish the <br /> actions authorized in subsequent sections of this ordinance. <br /> Section 2: Authorization is hereby granted to the Director of Parks and <br /> Recreation under the administration of the Mayor to design and <br /> construct improvements to Jetty Island including pathways, <br /> floats, signs, restroom, pier, gangway, landing ramp, and other <br /> miscellaneous site improvement as determined by the Director of <br /> Parks and Recreation. <br /> Section 3: The total estimated cost of the improvements authorized is <br /> $409,964 which shall include all costs related to design, <br /> construction, contract administration, plan development and <br /> associated costs. <br /> Section 4: A. The sum of $409,964 is hereby appropriated to Fund 352 <br /> Program 449 "Jetty Island Dock Facilities". <br /> B. Source of Funds: <br /> 1. 5150,000 - City of Everett General Fund <br /> 2. 5109,964 - Port of Everett <br /> 3. $150,000 - IAC Grant <br /> Section 5: This appropriation shall not lapse but shall be carried forward <br /> year to year until fully expended or the purpose has been <br /> accomplished or abandoned without the necessity of <br /> reappropriation as per RCW 35.33.151. <br /> SEVERABILITY <br /> If any provision of this Ordinance should be declared unconstitutional or <br /> invalid by any court of competent jurisdiction, it should be conclusively <br /> presumed that this Ordinance would have been inacted without the provision so <br /> held unconstitutional or invalid and the remainder of this Ordinance should <br /> not be affected as a result of said part being held unconstitutional or <br /> invalid. <br /> EPY-OF"EVERET <br /> 2 <br /> Pete Ki .+ , Mayor <br /> ATTE '�• <br /> /CI CLERK <br /> Passed: c"2/cRe9?) <br /> Valid: s��// .0 <br /> Published: ���10 <br /> 1077H <br />
