• <br /> ORDINANCE NO. ,/z 9d <br /> 1 <br /> 2 AN ORDINANCE creating a special fund entitled "Railroad Tunnel <br /> Subsidence Repairs Fund" to accumulate technical <br /> 3 consultation, design and repair costs for correction of <br /> recent problems on streets and alleys over the railroad <br /> 4 tunnel . <br /> 5 <br /> WHEREAS, on November 25, 1989, the railroad tunnel between Rucker and <br /> 6 <br /> Hoyt subsided, causing damage to streets, sidewalks, and utilities in the <br /> 7 <br /> public right-of-way and to structures on private property; and <br /> 8 <br /> WHEREAS, on November 29, 1989, the Everett City Council authorized a <br /> 9 <br /> geotechnical study to investigate the problem; and <br /> 10 <br /> WHEREAS, the Public Works Department has commenced repair of water and <br /> 11 <br /> sewer utilities and will be making further repairs pursuant to the <br /> 12 <br /> recommendations from the geotechnical study, and a budget of $100,000 is <br /> 13 <br /> preliminary estimated for continued study and repairs which should be shared <br /> 14 <br /> between the transit utility (for studies and repairs to allow buses to <br /> 15 <br /> 16 re-enter and use the street) , the water and sewer utility, and streets <br /> 17 (general fund) . <br /> 18 NOW, THEREFORE, THE CITY OF EVERETT ORDAINS: <br /> 19 Section 1 : A special repair fund is hereby established as fund program <br /> 20 entitled "Railroad Tunnel Subsidence Repairs" to pay all costs required in <br /> connection with the railroad tunnel subsidence. <br /> 21 <br /> 22 Section 2: The scope of this action shall be to accomplish all tasks <br /> 23 required to study the subsidence of public right-of-way above the railroad <br /> 24 tunnel and to make repairs caused thereby. <br /> Section 3: The total estimated cost of the studies and repairs herein <br /> 25 <br /> 26 authorized is $100,000 which shall include all repair costs, including <br /> 27 technical consultation, and administration. <br /> 28 Section 4: The sum of $100,000 is hereby appropriated to fund program <br /> 29 "Railroad Tunnel Subsidence Repairs" to accomplish the action required by <br /> 30 this ordinance. <br /> 31 Section 5: Authorization is hereby granted for the Public Works <br /> 32 Director/City Engineer, under the direction of the Mayor, to assume full and <br />
