<br /> 2 An Ordinance relating to drug paraphernalia and marihuana, adding a
<br /> new chapter to the Everett Criminal Code, Ordinance 1145-85 (EMC
<br /> 3 Title 10) , and repealing Ordinance No. 758-81 , and repealing
<br /> Sections 106, 144 and 145 of Ordinance No. 1145-85.

<br /> 6 WHEREAS, the 1989 Washington State Legislature enhanced the penalties
<br /> for misdemeanor violations of the Uniform Controlled Substances Act; and
<br /> 7
<br /> 8 WHEREAS, it is desirable for the City of Everett drug laws to be
<br /> 9 consistent with the corresponding State laws;
<br /> 10 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN:
<br /> 11 Section 1 : Drug Paraphernalia - Definitions.
<br /> A. As used in this chapter, "drug paraphernalia" means all
<br /> 12
<br /> 13 equipment, products, and materials of any kind which are used, intended for
<br /> 14 use, or designed for use in planting, propagating, cultivating, growing,
<br /> 15 harvesting, manufacturing, compounding, converting, producing, processing,
<br /> 16
<br /> preparing, testing, analyzing, packaging, repackaging, storing, containing,
<br /> 17 concealing, injecting, ingesting, inhaling, or otherwise introducing into
<br /> 18 the human body a controlled substance, as defined by RCW Chapter 69.50, as
<br /> 10 now or hereafter amended. It includes, but is not limited to:
<br /> 20 1 . Kits used, intended for use, or designed for use in
<br /> 21 planting, propagating, cultivating, growing, or harvesting
<br /> of any species of plant which is a controlled substance or
<br /> from which a controlled substance can be derived;
<br /> 22
<br /> 2. Kits used, intended for use, or designed for use in
<br /> 23 manufacturing, compounding, converting, producing,
<br /> 24 processing, or preparing controlled substances;
<br /> 25 3. Isomerization devices used, intended for use, or designed
<br /> for use in increasing the potency of any species of plant
<br /> which is a controlled substance;

<br /> 27 4. Testing equipment used, intended for use, or designed for
<br /> use in identifying or in analyzing the strength,
<br /> 28 effectiveness, or purity of controlled substances;
<br /> 29 5. Scales and balances used, intended for use, or designed for
<br /> use in weighing or measuring controlled substances;
<br /> 30 6. Diluents and adulterants, such as quinine hydrochloride,
<br /> 31 mannitol , mannite, dextrose, and lactose, used, intended for
<br /> use, or designed for use in cutting controlled substances;
