2924 _426 <br /> 1.2 Restricted Use. Pursuant to City Council Ordinance No. ^ , the property zoned <br /> B-2(community Business)is restricted to the following uses, in addition to those allowed in the <br /> Previous B-2(B) (Office)zone: <br /> Appliance service and sales <br /> Bakery <br /> Carpet sales <br /> Dry cleaner <br /> Furniture sales <br /> Health and fitness <br /> Laundromat <br /> Personal services(tailor,beauty, salon) <br /> Retail—indoor <br /> The B-2 zoned buildings shall appear as depicted in Exhibits B and C. In the event it <br /> becomes necessary to develop the B-2 zoned area without benefit of the use of the property <br /> abutting 96th Street, conditions found herein shall apply for the reduced area until such time as <br /> the,properties along 96`'' Street area brought into the project at which time their development <br /> shall be governed by this Agreement(see Recital E above). <br /> That portion of the site zoned R-2A shall appear and function as depicted in Exhibit"C." <br /> PART TWO—TERMS AND CONDITIONS <br /> 2.1 Effective Date—Revisions. This Agreement shall not become effective until it is <br /> fully executed and the entire site(Exhibit"A"and related provision found herein) comes under <br /> control of The Company. The Company shall be entitled to apply for a major revision to this <br /> Agreement under the same rules,regulations and fee provisions governing rezones in affect at <br /> the time of such application, as if this Agreement were null and void and The Company were <br /> starting from anew. <br /> 3 <br />
