THIS CONTRACT is made and entered into this day of ‘106V S^C , 2017, by and <br /> between the City of Everett,Washington, a municipal corporation existing under the laws of the <br /> State of Washington, hereinafter called the "City," and <br /> S i ELVAR '3 CoRPoR{rilot---4 , a <br /> MCaP.PO P,AT otJ , hereinafter called the "Contractor." <br /> B. In consideration of the sums to be paid to it by the City, Contractor hereby covenants and agrees <br /> ' to furnish all labor, tools,materials,equipment, and supplies required to build and construct and <br /> to build and construct in a workmanlike manner the Work, improvements, and appurtenances in <br /> accordance with the Specifications and Drawings entitled: "Portal 1 Replacement (UP3602)", <br /> (the"Project"). <br /> 1.2 DEFINITIONS <br /> A. Contract Documents. The following documents ("Contract Documents") are incorporated by <br /> reference and are hereby made a part of this Contract: <br /> 1. Notice to Bidders <br /> 2. Instructions to Bidders <br /> 3. General Conditions <br /> 4. Supplementary Conditions(if any) <br /> 5. Drawings, Standard Plans, and Specifications <br /> 6. Addenda(if any) <br /> 7. Payment and Performance Bond <br /> 8. Contractor's Bid Form <br /> 9. Other documents described as Contract Documents in Section 00 72 13, General <br /> Conditions <br /> 10. All provisions required by law whether set forth and reproduced herein or not. <br /> B. Terms that are capitalized in a Contract Document but not defined in that Contract Document <br /> shall have the meaning defined to them in the other Contract Documents. <br /> C. Contract Time. <br /> 1. Substantial Completion of the Work shall be achieved on or before June 14, 2018. <br /> 2. Physical Completion shall be within Twenty One (21) days after the actual date of <br /> issuance of substantial completion. <br /> D. Allowable Working Period. <br /> 1. The first day the Contractor may begin onsite working activities (excavation, shoring, <br /> demolition, and other required elements of the work), with the exception of mobilization, <br /> is April 15, 2018. <br /> 2.
