Section 3: Assumption of Indebtedness <br /> Upon annexation, the land area described in Section 1 shall become a part of the City of <br /> Everett, and shall be subject to all of its laws and ordinances then and thereafter in force. <br /> Upon annexation of the above-described land area, all property within the area shall be <br /> assessed and taxed at the same rate as other property located within the City. In addition, <br /> the annexed area will remain responsible unto any other lawfully formed municipal <br /> corporation to which the property is obliged at the time of annexation subject to a specific <br /> lien. Further, since the City may incur additional operating expenses in supplying water <br /> or sewage to persons who are located within the annexed area, utility rates for the <br /> property described in Section 1 may vary from rates of other areas within the City. <br /> Section 4: Land Use Designation <br /> The existing Comprehensive Plan designation of 1.4 (Single Family Attached, 12 to 15 <br /> dwellings per acre) is hereby affirmed as the Comprehensive Plan designation for the <br /> annexation area, according to the land use designation boundaries depicted on the <br /> attached map (Exhibit"B"). <br /> Section 5: Severability <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this ordinance or <br /> its application to any person or situation be declared unconstitutional or invalid for any <br /> reason, such decision shall not affect the validity of the remaining portions of this <br /> ordinance or its application to any other person or situation. The City Council of the City <br /> of Everett hereby declares that it would have adopted this ordinance and each section, <br /> subsection, paragraph, sentence, clause, phrase or portion thereof irrespective of the fact <br /> that any one or more sections, subsections, paragraphs, sentences, clauses, phrases or <br /> portions be declared invalid or unconstitutional. <br /> Section 6: Effective Date <br /> That the official map in the Planning and Community Development Department of the <br /> City of Everett shall, on December 28, 2006, be amended as herein provided, annexing <br /> the area into the City of Everett, and henceforth said property shall be used in accordance <br /> with the comprehensive plan map designations as depicted, and as provided by Ordinance <br /> No. 1671-89, as amended (Title 19, E.M.C.). <br /> Section 7: Notice to Snohomish County <br /> The City Clerk of the City of Everett is hereby directed upon passage of this ordinance of <br /> annexation to deliver and to file with the Snohomish County Council, the Snohomish <br /> County Auditor, the Snohomish County Boundary Review Board and the State of <br /> Washington, a certified copy of this ordinance of annexation. <br />
