1 Notwithstanding any language used in this code, it is not the <br /> intent of this code to create a duty and/or cause of action <br /> 2 running to any individual or identifiable person but rather any <br /> duty is intended to run only to the general public. <br /> 3 <br /> 4 Section 4: SEVERABILITY. <br /> 5 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 6 of this ordinance or its application to any person or situation be declared <br /> 7 unconstitutional or invalid for any reason, such decision shall not affect <br /> 8 the validity of the remaining portions of this ordinance or its application <br /> 9 to any other person or situation. The City Council of the City of Everett <br /> 10 hereby declares that it would have adopted this ordinance and each section, <br /> 11 subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> 12 fact that any one or more sections, subsections, sentences, clauses, phrases <br /> 13 or portions be declared invalid or unconstitutional . <br /> 14 Section 5: Ordinance No. 1614-89, State Energy Code, is hereby amended <br /> 15 by the addition of the following section: <br /> 16 <br /> Notwithstanding any language found in the State Energy Code, the <br /> 17 State Energy Code shall only apply to that construction not <br /> otherwise covered by the Model Conservation Standards Equivalent <br /> 18 Code Amendments to the Model Energy Code, June 1987 Edition, and <br /> any subsequent revisions as promulgated by the Bonneville Power <br /> 19 Administration, as adopted by the City. <br /> 20 <br /> Section 6: EFFECTIVE DATE. <br /> 21 <br /> This ordinance shall not become effective until such time as the City <br /> 22 <br /> and the Bonneville Power Administration (BPA) have executed a contract for <br /> 23 <br /> reimbursement of incremental costs and/or administrative enforcement costs <br /> 24 <br /> associated with the adoption of the Model Conservation Standards; provided, <br /> 25 <br /> 26 <br /> 27 <br /> 28 <br /> 29 <br /> 30 <br /> 31 <br /> 32 <br /> 4 <br />
