1 Notwithstanding any language used in this code, it is not the intent of this code to create a duty and/or cause of action 2 running to any individual or identifiable person but rather any duty is intended to run only to the general public. 3 4 Section 4: SEVERABILITY. 5 Should any section, subsection, paragraph, sentence, clause or phrase 6 of this ordinance or its application to any person or situation be declared 7 unconstitutional or invalid for any reason, such decision shall not affect 8 the validity of the remaining portions of this ordinance or its application 9 to any other person or situation. The City Council of the City of Everett 10 hereby declares that it would have adopted this ordinance and each section, 11 subsection, sentence, clause, phrase or portion thereof irrespective of the 12 fact that any one or more sections, subsections, sentences, clauses, phrases 13 or portions be declared invalid or unconstitutional . 14 Section 5: Ordinance No. 1614-89, State Energy Code, is hereby amended 15 by the addition of the following section: 16 Notwithstanding any language found in the State Energy Code, the 17 State Energy Code shall only apply to that construction not otherwise covered by the Model Conservation Standards Equivalent 18 Code Amendments to the Model Energy Code, June 1987 Edition, and any subsequent revisions as promulgated by the Bonneville Power 19 Administration, as adopted by the City. 20 Section 6: EFFECTIVE DATE. 21 This ordinance shall not become effective until such time as the City 22 and the Bonneville Power Administration (BPA) have executed a contract for 23 reimbursement of incremental costs and/or administrative enforcement costs 24 associated with the adoption of the Model Conservation Standards; provided, 25 26 27 28 29 30 31 32 4
