1 ORDINANCE NO. /4- .36 -k, <br /> 2 <br /> AN ORDINANCE relating to fraudulent activities, adding new <br /> 3 sections to Article 8 of Ordinance No. 1145-85 (EMC Chapter <br /> 10.56). <br /> 4 <br /> 5 THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1 : Fraud in Obtaining Telephone or Telegraph Service - Penalty. <br /> 7 <br /> Every person who, with intent to evade the provisions of any order of <br /> 8 <br /> the Washington utilities and transportation commission or of any tariff, <br /> 9 rule, or regulation lawfully filed with said commission by any telephone or <br /> 10 <br /> telegraph company, or with intent to defraud, obtains telephone or telegraph <br /> 11 <br /> service from any telephone or telegraph company through the use of a false <br /> 12 <br /> or fictitious name or telephone number or the unauthorized use of the name <br /> 13 <br /> or telephone number of another, or through any other trick, deceit, or <br /> 14 <br /> fraudulent device, shall be guilty of a misdemeanor. If the value of the <br /> 15 <br /> telephone or telegraph service which any person obtains in violation of this <br /> 16 <br /> section during a period of ninety days exceeds fifty dollars in the <br /> 17 <br /> aggregate, but does not exceed two hundred fifty dollars in the aggregate, <br /> 18 <br /> then such person shall be guilty of a gross misdemeanor. <br /> 19 <br /> Section 2: Encumbered, Leased or Rented Personal Property. <br /> 20 <br /> A. Every person being in possession thereof, who shall sell , remove, <br /> 21 <br /> conceal , convert to his own use, or destroy or connive at or consent to the <br /> 22 <br /> sale, removal , conversion, concealment or destruction of any personal <br /> 23 <br /> property or any part thereof, upon which a security agreement, mortgage, <br /> 24 <br /> lien, conditional sales contract, rental agreement, or lease exists, with <br /> 25 <br /> intent to hinder, delay, or defraud the secured party of such security <br /> 26 <br /> agreement, or the holder of such mortgage, lien, or conditional sales <br /> 27 <br /> contract or the lessor under such lease or rentor of [under] such rental <br /> 28 <br /> agreement, or any assignee of such security agreement, mortgage, lien, <br /> 29 <br /> conditional sales contract, rental agreement or lease shall be guilty of a <br /> 30 <br /> gross misdemeanor. <br /> 31 <br /> 32 <br />
