• <br /> 1 Section 5: Severability. <br /> 2 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 3 of this ordinance or its application to any person or situation be declared <br /> 4 unconstitutional or invalid for any reason, such decision shall not affect <br /> 5 the validity of the remaining portions of this ordinance or its application <br /> 6 to any other person or situation. The City Council of the City of Everett <br /> 7 hereby declares that it would have adopted this ordinance and each section, <br /> 8 subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> 9 fact that any one or more sections, subsections, sentences, clauses, phrases <br /> 10 or portions be declared invalid or unconstitutional . <br /> 11 Section 6: Third Party Liability. <br /> 12 It is expressly the purpose of this ordinance to provide for and <br /> 13 promote the health, safety and welfare of the general public and not to <br /> 14 create or otherwise establish or designate any particular class or group of <br /> 15 persons who will or should be especially protected or benefited by the terms <br /> 16 of this Chapter. <br /> 17 It is the specific intent of this ordinance that no provisions nor any <br /> 18 term used in this ordinance is intended to impose any duty whatsoever upon <br /> 19 the City or any of its officers or employees, for whom the implementation <br /> 20 and enforcement of this ordinance shall be discretionary and not mandatory. <br /> 21 Nothing contained in this ordinance is intended nor shall be construed <br /> 22 to create or form the basis of any liability on the part of the City, or its <br /> 23 officers, employees or agents, for any injury or damage resulting from any <br /> 24 action or inaction on the part of the City related in any manner to the <br /> 25 enforcement of this ordinance by its officers, employees or agents. <br /> 26 <br /> 27 , �1�'/fc '_ <br /> 28 LLIAM E.
