• 1 ORDINANCE NO. //6 ,35-f7 2 AN ORDINANCE relating to defrauding a public utility, adding a 3 new chapter to Title 10 EMC (Ordinance 1145-85 - Criminal Code) . 4 5 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1 : Definitions. 7 The definitions set forth in this section apply throughout this chapter. 8 A. "Customer" means the person in whose name a utility service is 9 provided. 10 B. "Divert" means to change the intended course or path of electricity, 11 gas, or water without the authorization or consent of the utility. 12 C. "Person" means an individual , partnership, firm, association, or 13 corporation or government agency. 14 D. "Reconnection" means the commencement of utility service to a 15 customer or other person after service has been lawfully disconnected by the 16 utility. 17 E. "Tamper" means to rearrange, injure, alter, interfere with, or 18 otherwise prevent from performing the normal or customary function. 19 F. "Utility" means an electrical company, gas company, or water 20 company as those terms are defined in RCW 80.04.010, and includes an 21 electrical , gas or water system operated by a public agency. 22 G. "Utility service" means the provision of electricity, gas, water, 23 or any other service or commodity furnished by the utility for compensation. 24 Section 2: Defrauding a Public Utility - Defined. 25 "Defrauding a public utility" means to commit, authorize, solicit, aid, 26 abet, or attempt to: 27 A. Divert, or cause to be diverted, utility services by any means 28 whatsoever; 29 B. Make, or cause to be made, a connection or reconnection with 30 property owned or used by the utility to provide utility service without the 31 authorization or consent of the utility; 32
