1 ORDINANCE NO. /6V.-.2 <br /> -.2 <br /> 2 <br /> AN ORDINANCE relating to police dogs, amending Section 77 of <br /> 3 Ordinance 1145-85 (EMC 10.12.140) . <br /> 4 <br /> 5 THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1 : Section 77 of Ordinance 1145-85 (EMC 10.12.140) , which <br /> 7 reads as follows: <br /> 8 <br /> Interference with police dog. <br /> 9 <br /> A. A person commits the offense of interference with a police <br /> 10 dog when he or she knowingly grabs, harasses, strikes, <br /> attempts to injure or to hold a collar of, or to interfere <br /> 11 with, any dog used by a peace officer in discharging or <br /> attempting to discharge any legal duty or power of his or <br /> 12 her office. <br /> 13 B. Interference with a police dog is a misdemeanor. <br /> 14 <br /> is hereby amended to read as follows: <br /> 15 <br /> 16 Interference with police dog. <br /> 17 A. A person commits the offense of interference with a police <br /> dog when he or she maliciously grabs, harasses, strikes, <br /> 18 attempts to injure or to hold a collar of, or interferes <br /> with any dog that the person knows or has reason to know to , <br /> 19 be a police dog, whether or not the dog is actually engaged <br /> in police work. <br /> 20 <br /> B. "Police dog" means a dog used by a law enforcement agency <br /> 21 specially trained for law enforcement and under the control <br /> of a dog handler. <br /> 22 <br /> C. "Dog handler" means a law enforcement officer who has <br /> 23 successfully completed training as prescribed by the <br /> Washington State Criminal Justice Training Commission in <br /> 24 police dog handling. <br /> 25 D. Interference with a police dog is a misdemeanor. <br /> 26 <br /> Section 2: Severability. <br /> 27 <br /> Should any section, subsection, paragraph, sentence, clause or phrase <br /> 28 <br /> of this ordinance or its application to any person or situation be declared <br /> 29 <br /> unconstitutional or invalid for any reason, such decision shall not affect <br /> 30 <br /> the validity of the remaining portions of this ordinance or its application <br /> 31 <br /> to any other person or situation.
