1 ORDINANCE NO. /6V.-.2 -.2 2 AN ORDINANCE relating to police dogs, amending Section 77 of 3 Ordinance 1145-85 (EMC 10.12.140) . 4 5 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1 : Section 77 of Ordinance 1145-85 (EMC 10.12.140) , which 7 reads as follows: 8 Interference with police dog. 9 A. A person commits the offense of interference with a police 10 dog when he or she knowingly grabs, harasses, strikes, attempts to injure or to hold a collar of, or to interfere 11 with, any dog used by a peace officer in discharging or attempting to discharge any legal duty or power of his or 12 her office. 13 B. Interference with a police dog is a misdemeanor. 14 is hereby amended to read as follows: 15 16 Interference with police dog. 17 A. A person commits the offense of interference with a police dog when he or she maliciously grabs, harasses, strikes, 18 attempts to injure or to hold a collar of, or interferes with any dog that the person knows or has reason to know to , 19 be a police dog, whether or not the dog is actually engaged in police work. 20 B. "Police dog" means a dog used by a law enforcement agency 21 specially trained for law enforcement and under the control of a dog handler. 22 C. "Dog handler" means a law enforcement officer who has 23 successfully completed training as prescribed by the Washington State Criminal Justice Training Commission in 24 police dog handling. 25 D. Interference with a police dog is a misdemeanor. 26 Section 2: Severability. 27 Should any section, subsection, paragraph, sentence, clause or phrase 28 of this ordinance or its application to any person or situation be declared 29 unconstitutional or invalid for any reason, such decision shall not affect 30 the validity of the remaining portions of this ordinance or its application 31 to any other person or situation.
