1 ORDINANCE NO. //4;,_33 - g 7 2 AN ORDINANCE relating to loaded firearms in vehicles, adding a 3 new section to Article 17 of Ordinance 1145-85 (EMC Chapter 10.78) . 4 5 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1 : Loaded Firearms in Vehicles. 7 A. It is a misdemeanor to carry, transport, convey, possess, or 8 control in or on a motor vehicle a shotgun or rifle containing shells or 9 cartridges in the magazine or chamber, or a muzzle-loading firearm loaded 10 and capped or primed. 11 B. While on duty within their respective jurisdictions, law 12 enforcement officers authorized to carry firearms are exempt from the 13 provisions of this section. 14 Section 2: Codification. 15 Section 1 of this ordinance shall be codified as one additional section 16 to EMC Chapter 10.78. 17 Section 3: Severability. 18 Should any section, subsection, paragraph, sentence, clause or phrase 19 of this ordinance or its application to any person or situation be declared 20 unconstitutional or invalid for any reason, such decision shall not affect 21 the validity of the remaining portions of this ordinance or its application 22 to any other person or situation. The City Council of the City of Everett 23 hereby declares that it would have adopted this ordinance and each section, 24 subsection, sentence, clause, phrase or portion thereof irrespective of the 25 fact that any one or more sections, subsections, sentences, clauses, phrases 26 or portions be declared invalid or unconstitutional . 27 Section 4: Third Party Liability. 28 It is expressly the purpose of this ordinance to provide for and 29 promote the health, safety and welfare of the general public and not to 30 create or otherwise establish or designate any particular class or group of 31 persons who will or should be especially protected or benefited by the terms 32 of this ordinance.
