1 ORDINANCE NO. //4;,_33 - <br /> g 7 <br /> 2 AN ORDINANCE relating to loaded firearms in vehicles, adding a <br /> 3 new section to Article 17 of Ordinance 1145-85 (EMC Chapter <br /> 10.78) . <br /> 4 <br /> 5 THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1 : Loaded Firearms in Vehicles. <br /> 7 A. It is a misdemeanor to carry, transport, convey, possess, or <br /> 8 control in or on a motor vehicle a shotgun or rifle containing shells or <br /> 9 cartridges in the magazine or chamber, or a muzzle-loading firearm loaded <br /> 10 and capped or primed. <br /> 11 B. While on duty within their respective jurisdictions, law <br /> 12 enforcement officers authorized to carry firearms are exempt from the <br /> 13 provisions of this section. <br /> 14 Section 2: Codification. <br /> 15 Section 1 of this ordinance shall be codified as one additional section <br /> 16 to EMC Chapter 10.78. <br /> 17 Section 3: Severability. <br /> 18 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 19 of this ordinance or its application to any person or situation be declared <br /> 20 unconstitutional or invalid for any reason, such decision shall not affect <br /> 21 the validity of the remaining portions of this ordinance or its application <br /> 22 to any other person or situation. The City Council of the City of Everett <br /> 23 hereby declares that it would have adopted this ordinance and each section, <br /> 24 subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> 25 fact that any one or more sections, subsections, sentences, clauses, phrases <br /> 26 or portions be declared invalid or unconstitutional . <br /> 27 Section 4: Third Party Liability. <br /> 28 It is expressly the purpose of this ordinance to provide for and <br /> 29 promote the health, safety and welfare of the general public and not to <br /> 30 create or otherwise establish or designate any particular class or group of <br /> 31 persons who will or should be especially protected or benefited by the terms <br /> 32 of this ordinance. <br />
