On January 10, 2007, the City Council held a public hearing on this <br /> Ordinance to renew Ordinance No. 2920-06 for six months; and <br /> WHEREAS, the City Council does conclude: <br /> 1. The City does have the authority to establish interim regulations and <br /> renew them; and <br /> 2. The City must adopt interim regulations concerning the establishment and <br /> processing of applications for homeless encampments in order to act as a <br /> stop-gap measure: (a) to provide the City an opportunity to study the issues <br /> concerning the siting of uses and prepare appropriate revisions to the City's <br /> regulations; and (b) to avoid applicants possibly establishing vested rights <br /> contrary to and inconsistent with any revisions the City may make to its <br /> regulatory scheme as a result of the City's study of this matter; and <br /> 3. An emergency does exist to protect the public health, safety and welfare. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Findings of Fact. The "WHEREAS" provisions above shall <br /> constitute findings of fact and are incorporated by reference as if fully set forth <br /> herein. <br /> Section 2. Interim Regulation Renewed. Ordinance No. 2920-06, which <br /> concerns the establishment and processing of applications for homeless <br /> encampments in the City, is hereby renewed. The interim regulation set forth <br /> in Ordinance No. 2920-06 is incorporated by reference as if fully set forth <br /> herein and shall remain in full force and effect for the period of the renewal. <br /> Section 3. Term. The interim regulation renewed by this Ordinance shall be <br /> effective for six (6) months after passage of this Ordinance unless earlier <br /> repealed or renewed according to law. <br /> Section 4. Severability. <br /> If any section, subsection, clause, sentence, or phrase of this ordinance <br /> should be held invalid or unconstitutional, such decision shall not affect the <br /> validity of the remaining portions of this ordinance. <br /> Section 5. No intent to create protected/benefited class. <br /> This Ordinance is intended to promote the health, safety and welfare of the <br /> general public. Nothing contained in this Ordinance is intended to be nor <br /> shall be construed to create or otherwise establish any particular class or <br /> group of persons who will or should be especially protected or benefited by <br /> 3 <br />
