,r• 1 ORDINANCE NO. ,/6p2‘• 2 AN ORDINANCE amending the City 's Animal Control Ordinance, Ordinance No. 680-80 (EMC 6.04) , to establish offenses 3 relating to safety and sanitation. 4 THE CITY OF EVERETT DOES ORDAIN: 5 Section 1 : Ordinance No. 680-80 (EMC 6.04) is hereby amended by the addition of the following: 6 7 It is unlawful for an owner to: 8 A. Allow the accumulation of cat or dog feces in any open area, run, cage or yard wherein dogs and/or cats are kept 9 and to fail to remove or dispose of feces at least once every twenty-four (24) hours; 10 B. Fail to remove the fecal matter deposited by his/her 11 animal on public property or private property of another before the owner leaves the immediate area where the fecal matter was 12 deposited; 13 C. Fail to have in his/her possession the equipment necessary to remove his/her animal 's fecal matter when 14 accompanied by said animal on public property or public easement. 15 Owners of duly licensed guide dogs shall be exempted from subsections B and C of this section. 16 17 Section 2: VALIDITY. 18 Should any section, subsection, paragraph, sentence, clause or phrase 19 of this ordinance or its application to any person or situation be declared 20 unconstitutional or invalid for any reason, such decision shall not affect 21 the validity of the remaining portions of this ordinance or its application 22 to any other person or situation. The City Council of the City of Everett 23 hereby declares that it would have adopted this ordinance and each section, 24 subsection, sentence, clause, phrase or portion thereof irrespective of the 25 fact that any one or more sections, subsections, sentences, clauses, phrases 26 or portions be declared invalid or unconstitutional . 27 •_.r/iii . .�i 28 IL IAM E.
