,r• <br /> 1 ORDINANCE NO. ,/6p2‘• <br /> 2 AN ORDINANCE amending the City 's Animal Control Ordinance, <br /> Ordinance No. 680-80 (EMC 6.04) , to establish offenses <br /> 3 relating to safety and sanitation. <br /> 4 THE CITY OF EVERETT DOES ORDAIN: <br /> 5 Section 1 : Ordinance No. 680-80 (EMC 6.04) is hereby amended by the <br /> addition of the following: <br /> 6 <br /> 7 It is unlawful for an owner to: <br /> 8 A. Allow the accumulation of cat or dog feces in any <br /> open area, run, cage or yard wherein dogs and/or cats are kept <br /> 9 and to fail to remove or dispose of feces at least once every <br /> twenty-four (24) hours; <br /> 10 B. Fail to remove the fecal matter deposited by his/her <br /> 11 animal on public property or private property of another before <br /> the owner leaves the immediate area where the fecal matter was <br /> 12 deposited; <br /> 13 C. Fail to have in his/her possession the equipment <br /> necessary to remove his/her animal 's fecal matter when <br /> 14 accompanied by said animal on public property or public easement. <br /> 15 Owners of duly licensed guide dogs shall be exempted from <br /> subsections B and C of this section. <br /> 16 <br /> 17 Section 2: VALIDITY. <br /> 18 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 19 of this ordinance or its application to any person or situation be declared <br /> 20 unconstitutional or invalid for any reason, such decision shall not affect <br /> 21 the validity of the remaining portions of this ordinance or its application <br /> 22 to any other person or situation. The City Council of the City of Everett <br /> 23 hereby declares that it would have adopted this ordinance and each section, <br /> 24 subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> 25 fact that any one or more sections, subsections, sentences, clauses, phrases <br /> 26 or portions be declared invalid or unconstitutional . <br /> 27 •_.r/iii . .�i <br /> 28 IL IAM E.
