• • 1 ORDINANCE NO. 2 AN ORDINANCE amending the City 's licensing regulations for 3 taxicabs and amending Sections 8, 13, 23 and 38 of Ordinance No. 1400-87. 4 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1 : That Section 8 of Ordinance No. 1400-87 (EMC 5.68.100) 7 which reads as follows: 8 9 Section 8: SUSPENSION, REVOCATION AND DENIAL - HEARINGS AND APPEALS 10 A. "Suspension" of a license means that the licensee's 11 privilege to operate his/her business (in the case of a for-hire license) or to operate a for-hire vehicle (in the 12 case of a driver's license) is barred for a specific period of time. A suspended license may be reinstated upon the 13 lapse of a specified period of time or by correcting the deficiencies. The conditions of reinstatement will be 14 determined by the City Clerk. 15 B. "Revocation" of a license means that the license has been cancelled. A licensee whose license has been revoked 16 cannot have his license reinstated but must comply with all conditions of revocation including re-applying for a new 17 license and paying all license fees. 18 C. When the City Clerk suspends or revokes a for-hire vehicle business license or driver's license, the City Clerk shall 19 first provide the licensee with a Notice of Proposed Suspension/Revocation which shall provide notification to 20 the licensee that a hearing will be held on the revocation/suspension at a time or date determined by the 21 City Clerk. The Notice of Proposed Suspension/Revocation will be sent to the licensee at the address found on the 22 licensee's application. It is the licensee's duty to keep the address information on the application current at all 23 times. The City Clerk will preside over the hearing. In the event the licensee fails to attend the hearing, the 24 license will automatically be revoked/suspended. Any revocation/suspension will not be effective until the City 25 Clerk makes a determination following the hearing. 26 D. Notwithstanding subsection C herein, a license suspension/revocation shall become effective immediately 27 without the benefit of any pre-suspension/revocation hearing when the ordinance requires a summary 28 revocation/suspension or when the City Clerk determines that it is in the best interest of the health and/or safety 29 of the citizens of Everett to do so. 30 E. Within ten days following revocation or suspension of any license issued pursuant to this ordinance, or within ten 31 days following the denial of any license regulated by this ordinance, an appeal may be filed with the City Council . 32 Upon the receipt of such notice, the licensee shall be
