• <br /> • <br /> 1 ORDINANCE NO. <br /> 2 AN ORDINANCE amending the City 's licensing regulations for <br /> 3 taxicabs and amending Sections 8, 13, 23 and 38 of <br /> Ordinance No. 1400-87. <br /> 4 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1 : That Section 8 of Ordinance No. 1400-87 (EMC 5.68.100) <br /> 7 which reads as follows: <br /> 8 <br /> 9 Section 8: SUSPENSION, REVOCATION AND DENIAL - HEARINGS <br /> AND APPEALS <br /> 10 A. "Suspension" of a license means that the licensee's <br /> 11 privilege to operate his/her business (in the case of a <br /> for-hire license) or to operate a for-hire vehicle (in the <br /> 12 case of a driver's license) is barred for a specific period <br /> of time. A suspended license may be reinstated upon the <br /> 13 lapse of a specified period of time or by correcting the <br /> deficiencies. The conditions of reinstatement will be <br /> 14 determined by the City Clerk. <br /> 15 B. "Revocation" of a license means that the license has been <br /> cancelled. A licensee whose license has been revoked <br /> 16 cannot have his license reinstated but must comply with all <br /> conditions of revocation including re-applying for a new <br /> 17 license and paying all license fees. <br /> 18 C. When the City Clerk suspends or revokes a for-hire vehicle <br /> business license or driver's license, the City Clerk shall <br /> 19 first provide the licensee with a Notice of Proposed <br /> Suspension/Revocation which shall provide notification to <br /> 20 the licensee that a hearing will be held on the <br /> revocation/suspension at a time or date determined by the <br /> 21 City Clerk. The Notice of Proposed Suspension/Revocation <br /> will be sent to the licensee at the address found on the <br /> 22 licensee's application. It is the licensee's duty to keep <br /> the address information on the application current at all <br /> 23 times. The City Clerk will preside over the hearing. In <br /> the event the licensee fails to attend the hearing, the <br /> 24 license will automatically be revoked/suspended. Any <br /> revocation/suspension will not be effective until the City <br /> 25 Clerk makes a determination following the hearing. <br /> 26 D. Notwithstanding subsection C herein, a license <br /> suspension/revocation shall become effective immediately <br /> 27 without the benefit of any pre-suspension/revocation <br /> hearing when the ordinance requires a summary <br /> 28 revocation/suspension or when the City Clerk determines <br /> that it is in the best interest of the health and/or safety <br /> 29 of the citizens of Everett to do so. <br /> 30 E. Within ten days following revocation or suspension of any <br /> license issued pursuant to this ordinance, or within ten <br /> 31 days following the denial of any license regulated by this <br /> ordinance, an appeal may be filed with the City Council . <br /> 32 Upon the receipt of such notice, the licensee shall be <br />
