• <br /> is hereby amended to read as follows: <br /> If the topography of a lot is such that the front building setback line is eight feet or <br /> more above the street grade, and there is no reasonable way to construct a driveway up <br /> to the dwelling level, a garage/carport may be built into the bank provided it is set back <br /> at least five feet from the front property line and does not exceed 15 feet in height. <br /> Section 9: Subsection 24 of Paragraph A of Section 2(B) of Chapter 4 of Ordinance <br /> 2530-01, Chapter 4 (EMC 15.16.050.24)which currently reads as follows: <br /> 24. Rockeries and retaining walls for a cut or slope (not to retain fill) in excess of <br /> thirty-six inches in height in required building setback areas, as provided by Section <br /> 19.39.150(c)(5); <br /> is hereby repealed. <br /> Section 10:. Paragraph A of Section 3(B) of Chapter 4 of Ordinance 2530-01, <br /> Chapter 4 (EMC 15.16.080) is amended by the addition of the following: <br /> Accessory buildings over 200 square feet which have metal siding or corrugated roofing <br /> as provided by EMC 19.07.020.K. <br /> Accessory buildings which exceed 1,000 square feet in area as provided by EMC <br /> I9.07.020.J. <br /> Accessory buildings which exceed 15 feet in height as provided by EMC 19.07.020.M. <br /> Rockeries and retaining walls retaining soil (fill) four feet or greater in height in required <br /> building setback areas, as provided by Section 19.39.150.C.5.d. <br /> Section 11. Severability. Should any section, paragraph, clause or phrase of this <br /> Ordinance, or its application to any person or circumstance, be declared unconstitutional <br /> or otherwise invalid for any reason, or should any portion of this Ordinance be pre- <br /> empted by state or federal law or regulations, this shall not affect the validity of the <br /> remaining portions of this Ordinance or its application to other persons or circumstances. <br /> Section 12. Conflict. In the event there is a conflict between the provisions of this <br /> Ordinance and any other City ordinance, the provisions of this Ordinance shall control. <br /> Section 13: The City Clerk and the codifiers of this Ordinance are authorized to make <br /> necessary corrections to this Ordinance including, but not limited to, the correction of <br /> scrivener's/clerical errors, references, ordinance numbering, section/subsection number <br /> and any references thereto. <br />
