0001p 440.1°V.dif ORDINANCE NO. 2985-07 AN ORDINANCE providing for the adoption of the 2003 edition of the International Fire Code, as amended by the Washington State Building Code Council in Chapter 51-54 of the Washington Administrative Code, repealing Ordinance No. 2360-99, Sections 1 through 12, and amending Section 1 (part) of Ordinance No. 351-75 as amended by Section 1 of Ordinance No. 2337-98 (EMC 16.64.010). Whereas, the City Council finds that this ordinance serves to protect the public health, safety and welfare; and Whereas, the City Council finds that the absence of the regulations adopted by this ordinance would create a public harm and a public nuisance; and Whereas, the City Council has been advised that the State Building Code Council, established with authority granted by the state legislature, has adopted and made revisions to the 2003 edition of the International Fire Code; and Whereas, the City Council finds that the City is mandated by the State to implement and enforce the herein adopted code; and Whereas, the City Charter allows adoption of codes or portions thereof by reference; and Whereas,the City Council finds that it is appropriate for the Board of Review to have discretionary power to approve plans and a time frame for bringing existing buildings into compliance with this ordinance so long as the requirements are not waived and the time frame does not exceed one year; NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: Short title. This Ordinance shall be known as the"Everett Fire Code". Section 2: Fire department established. There is hereby established in the City of Everett, the Fire Department which shall be under the jurisdiction of the Fire Chief, designated by the Mayor. Section 3: International Fire Code adopted-Code Conflicts. A.
