Section 108 of the IFC, entitled "Board of appeals," is hereby deleted and the following <br /> inserted in its place: <br /> 108 Board of Review. For the purpose of determining suitable alternate <br /> materials, alternate types and methods of construction, a proposed equivalent <br /> method of protection or safety and reasonable interpretations regarding the <br /> Everett Fire Code, any person aggrieved by an order or action of the Fire Code <br /> Official who does not have an enforcement procedure pending pursuant to <br /> Chapter 1.20 EMC, may file a written request with the City Clerk requesting a <br /> determination by the Board of Review. The aggrieved party must file such request <br /> within thirty (30) calendar days from the date of receipt of the written order and <br /> shall cause to be made at his own expense any tests or research required to <br /> substantiate the request. The Board shall not have any authority to waive the <br /> requirements of this Code, but may approve plans and a time frame for bringing <br /> an existing building into compliance with this Code's requirements, provided that <br /> time frame does not exceed one year. <br /> F. Section 109 of the IFC, entitled "Violations," is hereby deleted and the following inserted <br /> in its place: <br /> Section 109 VIOLATIONS <br /> 109.1 Authority to abate. <br /> 1. Any violation of the Everett Fire Code ("Fire Code") determined to exist after <br /> inspection by the Fire Code Official is hereby declared to be a nuisance. <br /> 2. Where a nuisance exists, the City Attorney on behalf of the City is authorized to <br /> institute injunction, mandamus, or other appropriate action or proceeding to <br /> prevent the violation of the Fire Code. <br /> 3. Notwithstanding paragraph(2), the City Attorney is authorized to apply to any <br /> court of competent jurisdiction for and such court, upon hearing and for cause <br /> shown, may grant a temporary or permanent injunction restraining any person, firm <br /> and/or corporation from violating any provisions of the Fire Code. <br /> 109.2 Fire Code Official order. <br /> 1. The Fire Code Official hereby has the authority to order dangerous structures, <br /> buildings, places, conditions, or materials to be removed, corrected, vacated or <br /> demolished in such manner as shall be set forth in an order, which shall be in <br /> substantially the following form: <br /> FIRE CODE OFFICIAL ORDER <br /> City of Everett <br /> 3 <br />
