Under new state law,however,the City may assume the rights and obligations of the TBD. Under the <br /> new state legislation(2015 -2ESSB 5987) a city that forms a TBD with the same boundaries as the city is <br /> allowed to assume all of its"rights,powers, functions,and obligations,"with the result that the TBD would <br /> cease to exist as a separate entity. After the assumption the City continues the work and functions of the <br /> TBD as defined in state law and the proposed Ordinance. <br /> The main advantage of this is that it will streamline processes. The work and functions of the TBD as <br /> defined in state law and the Everett Municipal Code would be conducted through regular Council process <br /> and not require separate meetings or boards. <br /> RECOMMENDATION (Exact action requested of Council): Adopt an Ordinance to assume the Everett <br /> Transportation Benefit District. <br /> 19 <br />
