,4P* <br /> ORDINANCE NO. 2992-07litig412 <br /> An Ordinance Amending the City's Local Project Review Procedures, <br /> Section 6(A) of Chapter 4 of Ordinance No. 2530-01 (EMC 15.16.320). <br /> WHEREAS, the City did adopt the Local Project Review Procedures (EMC Title 15) in <br /> 2001 to establish a comprehensive set of procedures for the processing of land use <br /> permits and actions; and <br /> WHEREAS, the City has identified a housekeeping amendment to the City's Local <br /> Project Review Procedures (EMC Title 15) that is necessary to provide clarity and <br /> effective administration of the City's land use procedures; and <br /> WHEREAS, the City Council finds that the amendment to the City's Local Project <br /> Review Procedures (EMC Title 15) promotes the best long term interests of the Everett <br /> community. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 6(A) of Chapter 4 of Ordinance No. 2530-01 (EMC 15.16.320), <br /> which reads as follows: <br /> City council decision making. Two types of discretionary decisions are made by city <br /> council. One type of decision relates to legislative decisions and shall be governed solely <br /> by Chapter 15.32 EMC (see EMC 15.16.350 for an illustrative list of these actions). A <br /> second type is a quasi-judicial decision that relates to an approval of a specific proposed <br /> project on specific property, which shall follow Review Process IIIB and Review Process <br /> VA and VB procedures in this chapter. This type of decision does not include a request to <br /> city council to authorize or fund a city project or to participate in a project that will <br /> subsequently be applying for a land use permit (which shall be legislative decisions). <br /> Is hereby amended to read as follows: <br /> City council decision making.
