• I r <br /> • <br /> • <br /> ORDINANCE NO. //67/ (-j747 <br /> AN ORDINANCE adopting the State Energy Code <br /> and repealing Ordinance 1250-86 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: The State Energy Code, Chapter 51-12 Washington Administrative <br /> Code and amendments adopted by the State Building Code Council on January 20, <br /> 1989 are hereby adopted by reference except for such portions as are modified <br /> or amended by this ordinance. <br /> Section 2: Amendments Made In The State Energy Code. <br /> A. WAC 51-12-102, Scope of the Washington State Energy Code, is hereby <br /> amended by the addition of the following language: <br /> (c) Residences Built to More Stringent Standards. <br /> Single family residences (including duplexes) which are built to standards <br /> found in the Super Good Cents Technical Reference Manual or the Model <br /> Conservation Standards adopted by the Regional Power Planning Council <br /> shall be equipped with an air-to-air heat exchanger. <br /> The air-to-air heat exchanger system shall comply with the requirements of <br /> the latest version of the Bonneville Power Administration's Installation <br /> and Operations Guidelines for Air-to-Air Heat Exchangers. <br /> B. The State Energy Code is hereby amended by the addition of the <br /> following: <br /> Authority to Abate <br /> a. Any violation of the Code is hereby declared to be a nuisance. <br /> b. Where a nuisance exists, the City Attorney on behalf of the City is <br /> authorized to institute an injunction, mandamus, or other <br /> appropriate action or proceeding to prevent the violation of this <br /> Code. <br /> c. Notwithstanding paragraph (b) , the City Attorney is authorized to <br /> apply to any court of competent jurisdiction for and such court, <br /> upon hearing and for cause shown, may grant a temporary or <br /> permanent injunction restraining any person, firm and/or <br /> corporation from violating any provision of this Code and <br /> compelling compliance herewith. The cost of such action shall be <br /> taxed against the violator. <br /> d. A conviction of any person, firm or corporation for violating this <br /> Code shall not impede the authority granted in this section to the <br /> City Attorney or City. <br />
