ORDINANCE NO. / ,' -f,i AN ORDINANCE adopting the Washington State Regulations for Barrier-Free Facilities, October 1, 1976 as amended October 1, 1976, April 18, 1979 and November 18, 1988. WHEREAS, the City of Everett desires to provide for standards and specifications for making buildings and facilities accessible to and usable by physically handicapped persons; and WHEREAS, the State of Washington Regulations for Barrier-Free Facilities as promulgated by the Washington State Building Code Council is enacted herein as protection to the general public and not to create a duty to or in favor of persons individually; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: The Regulations for Barrier-Free Facilities as promulgated by the State of Washington Building Code Advisory Council amended October 1, 1976, April 18, 1979, November 18, 1988 and as amended herein is hereby adopted and enacted by reference as though fully set forth at length herein. Section 2: Section 002. of the Regulations for Barrier-Free Facilities as promulgated by the Washington State Building Code Advisory Council is hereby amended to read as follows: Purpose Section 002. It is expressly the purpose of this Code to provide for and promote the health, safety and welfare of the general public, and not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this Code. It is the specific intent of this Code that no provision nor any term used in this Code is intended to impose any duty whatsoever upon the City or any of its officers or employees, for whom the implementation or enforcement of this Code shall be discretionary and not mandatory.
