ORDINANCE NO. / ,' -f,i <br /> AN ORDINANCE adopting the Washington State <br /> Regulations for Barrier-Free Facilities, <br /> October 1, 1976 as amended October 1, 1976, <br /> April 18, 1979 and November 18, 1988. <br /> WHEREAS, the City of Everett desires to provide for standards and <br /> specifications for making buildings and facilities accessible to and usable by <br /> physically handicapped persons; and <br /> WHEREAS, the State of Washington Regulations for Barrier-Free <br /> Facilities as promulgated by the Washington State Building Code Council is <br /> enacted herein as protection to the general public and not to create a duty to <br /> or in favor of persons individually; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: The Regulations for Barrier-Free Facilities as <br /> promulgated by the State of Washington Building Code Advisory Council amended <br /> October 1, 1976, April 18, 1979, November 18, 1988 and as amended herein is <br /> hereby adopted and enacted by reference as though fully set forth at length <br /> herein. <br /> Section 2: Section 002. of the Regulations for Barrier-Free <br /> Facilities as promulgated by the Washington State Building Code Advisory <br /> Council is hereby amended to read as follows: <br /> Purpose <br /> Section 002. It is expressly the purpose of this Code to <br /> provide for and promote the health, safety and welfare of the <br /> general public, and not to create or otherwise establish or <br /> designate any particular class or group of persons who will or <br /> should be especially protected or benefited by the terms of this <br /> Code. <br /> It is the specific intent of this Code that no provision nor any <br /> term used in this Code is intended to impose any duty whatsoever <br /> upon the City or any of its officers or employees, for whom the <br /> implementation or enforcement of this Code shall be discretionary <br /> and not mandatory. <br />
