• <br /> 3, <br /> 1 ORDINANCE NO. /6eLe- 19 <br /> 2 AN ORDINANCE amending Section 1 of Ordinance No. 1229-86 <br /> 3 (EMC 46.30.120) which provide for residential permit <br /> parking zones by defining the terms "residence" and <br /> 4 "resident" . <br /> 5 THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1 : Section 1 of Ordinance No. 1229-86 (EMC 46.30.120) which <br /> 7 reads as follows: <br /> 8 <br /> 9 Permit - Eligibility. <br /> 10 Eligibility for residential parking zone permits shall be <br /> established upon proof of residence within the zone for which the <br /> 11 permit is sought and proof of ownership and/or control of the <br /> motor vehicle. Proof of residence shall be established by <br /> 12 display of a valid driver 's license reflecting the current <br /> address within the zone; or by display of a deed or other legal <br /> 13 document showing ownership, of not less than one quarter <br /> interest, or other residency of a parcel of real property within <br /> 14 the zone; or by display of a notarized statement or occupancy <br /> provided by the lessor to his lessee/renter together with proof <br /> 15 of ownership by the lessor. Proof of ownership and/or control of <br /> a motor vehicle shall be established by possession of a valid <br /> 16 registration or other indicia of title, or by display of valid <br /> registration of the vehicle to another person accompanied by <br /> 17 proof that applicant has use and control of the vehicle. <br /> 18 No residential parking zone permit shall be issued to any <br /> resident who, in the opinion of the City's Traffic Engineer or <br /> 19 his designee, has sufficient off-street parking to provide <br /> parking for those vehicles owned or controlled by the applicant. <br /> 20 <br /> 21 Be and the same is hereby amended to read as follows: <br /> 22 Permit - Eligibility. <br /> 23 A. The term "residence" as used herein applies only to a place <br /> 24 where one lives and excludes property which is used <br /> exclusively as a place of business or for any other purpose <br /> 25 other than uses which include the property as the person's <br /> place of abode. <br /> 26 The term "resident" as used herein applies only to a person <br /> 27 who lives in a "residence" as described herein and does not <br /> extend to a person who occupies a structure solely as a <br /> 28 place of business. <br /> 29 B. Eligibility for residential parking zone permits shall be <br /> established upon proof of residence within the zone for <br /> 30 which the permit is sought and proof of ownership and/or <br /> control of the motor vehicle.
