WITNESSETH <br /> WHEREAS, the undersigned is (are) the owner (s) of or has <br /> (have) a substantial interest in the real property legally <br /> described above ("Property") ; and <br /> WHEREAS, the Grantee/Covenantee, the City of Everett <br /> ("City") has a substantial interest in the effective and <br /> safe use of lands within its borders, and in the health, <br /> safety and welfare of its citizens; and <br /> WHEREAS, the Owner (s) have applied for permission to place, <br /> construct and maintain a secondary kitchen (s) within a <br /> single family dwelling unit or resident; and <br /> WHEREAS, before the City will issue any permit or approval <br /> for a secondary kitchen to be placed, constructed or <br /> maintained within a single family dwelling unit on the <br /> Property, this Covenant must be signed, acknowledged and <br /> recorded in the records of Snohomish County as a restrictive <br /> covenant, restricting the use and enjoyment of the Property <br /> by placing conditions on the permission to place, construct <br /> or maintain a secondary kitchen; and <br /> WHEREAS, this Covenant concerns the Grantor/Covenantor' s <br /> use, occupation, enjoyment of the Property and benefits the <br /> City as Grantee/Covenantee; and <br /> WHEREAS, this Covenant is intended to bind successors and <br /> assigns and run with the land; <br /> NOW, THEREFORE, Owner (s) agree (s) to abide by restrictions <br /> on occupation, use, and enjoyment of the Property as <br /> follows : <br /> 1 .Owner (s) agree that the single family residence shall not <br /> be used for any purpose which is not in full compliance with <br /> the conditions of this Covenant and with all City of Everett <br /> zoning and building regulations. <br /> 2 .Owner (s) agree that the internal connection (s) between all <br /> living spaces within the single family dwelling shall remain <br /> and meet City of Everett building regulations . <br /> 3 .Owner (s) agree that the occupants of the single family <br /> dwelling shall meet the definition of family as defined in <br /> the City of Everett zoning code. As of April 1, 2004, family <br /> means any number of persons related by blood, marriage or <br /> legal adoption and including foster children and exchange <br />
