WHEREAS, the proposed amendment to the PDO master plan will require an amendment to the <br /> 2002 Development Agreement; and <br /> WHEREAS, the City Council finds the following: <br /> 1. The proposed amendment to the master plan and Development Agreement established by <br /> the rezone of the Snohomish County Campus through the rezone to the PDO zone is <br /> consistent with the Everett comprehensive plan; and <br /> 2. The proposed amendment bears a substantial relation to public health, safety or welfare; <br /> and the proposed rezone promotes the best long-term interests of the Everett community; and <br /> 3. The proposed amendment mitigates any adverse impact(s) upon existing or anticipated <br /> land uses in the immediate vicinity of the subject property. <br /> NOW, THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> EVERETT: <br /> Section 1. Amendment to Master Site Plan <br /> The City approves an amendment to the master site plan contained in Exhibit B (Development <br /> Agreement)to Resolution No. 5248 to allow an addition to the existing Snohomish County <br /> Courthouse in accordance with the First Amendment to the Development Agreement. <br /> Section 2. First Amendment to Development Agreement <br /> The Mayor is hereby authorized to execute the First Amendment to the Development Agreement <br /> amending the site plan for the Snohomish County Campus to allow the expansion of the <br /> Snohomish County Courthouse substantially as shown in the attached exhibits. <br /> Section 3. Recording <br /> A copy of this Resolution, and a copy of the First Amendment to the Development Agreement <br /> shall be recorded with the Snohomish County Auditor's Office and shall constitute a covenant <br /> running with the land.
