WHEREAS, the proposed amendment to the PDO master plan will require an amendment to the 2002 Development Agreement; and WHEREAS, the City Council finds the following: 1. The proposed amendment to the master plan and Development Agreement established by the rezone of the Snohomish County Campus through the rezone to the PDO zone is consistent with the Everett comprehensive plan; and 2. The proposed amendment bears a substantial relation to public health, safety or welfare; and the proposed rezone promotes the best long-term interests of the Everett community; and 3. The proposed amendment mitigates any adverse impact(s) upon existing or anticipated land uses in the immediate vicinity of the subject property. NOW, THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT: Section 1. Amendment to Master Site Plan The City approves an amendment to the master site plan contained in Exhibit B (Development Agreement)to Resolution No. 5248 to allow an addition to the existing Snohomish County Courthouse in accordance with the First Amendment to the Development Agreement. Section 2. First Amendment to Development Agreement The Mayor is hereby authorized to execute the First Amendment to the Development Agreement amending the site plan for the Snohomish County Campus to allow the expansion of the Snohomish County Courthouse substantially as shown in the attached exhibits. Section 3. Recording A copy of this Resolution, and a copy of the First Amendment to the Development Agreement shall be recorded with the Snohomish County Auditor's Office and shall constitute a covenant running with the land. All conditions and attachments to this Resolution are binding upon the property and all future owners with any interest in the property described herein.
