Cell Site No.WA-808-01 <br /> Cell Site Name: Everett Golf&Country Club <br /> Fixed Asset No.10033054 <br /> Market:SEATTLE/OREGON/NO.ID <br /> Address:6107 Berkshire Drive,Everett,WA 98203 <br /> is hereby deleted in its entirety.. <br /> 9. Memorandum of Lease. Either party will, at any time upon thirty (30) days prior <br /> written notice from the other, execute, acknowledge and deliver to the other a recordable <br /> Memorandum of Lease substantially in the form of the Attachment 1. Either party may record <br /> this memorandum at any time, in its absolute discretion. <br /> 10. Expansion of Use of the Site. Lessor, to the extent practicable and on a space <br /> available basis, will allow the Lessee the right to enlarge its use of the Site so that Lessee or its <br /> authorized sublessees may implement any necessary modifications, supplements, replacements, <br /> refurbishments, or expansions to the communication facility or to any equipment related thereto, <br /> or for any other reasons, as determined by Lessee subject to Lessor approval. Should Lessee <br /> exercise the right to expand its use of the Site, Lessee will pay and Lessor will accept as <br /> additional Rental Fee under the Lease an amount equal to the then current Rental Fee calculated <br /> on a per square foot basis as multiplied by each additional square foot added to the use of the <br /> Site. Any modification of the use of the Site shall become part of the Lease by written <br /> addendum to the Lease. At the request of Lessee, the parties will execute a Memorandum of <br /> Lease in recordable form memorializing the modification of the use of the Site and Lease <br /> addendum, which either party may record at its option. <br /> 11. Remainder of Lease Unaffected. The parties hereto acknowledge that except as <br /> expressly modified hereby, the Lease remains unmodified and in full force and effect. In the <br /> event of any conflict or inconsistency between the terms of this First Addendum and the Lease, <br /> the terms of this First Addendum shall control. This First Addendum may be executed <br /> simultaneously or in counterparts, each of which shall be deemed an original, but all of which <br /> together shall constitute one and the same agreement. <br /> Site Names: 5 <br /> Reservoir 3 Site;Everett Water Tank <br />
