CITY <br /> LEASE AGREEMENT <br /> • <br /> This Lease is made this I kr day of N U Am be'72017, between the City of Everett, a <br /> municipal corporation under the laws of the State of Washington,hereinafter referred to as the <br /> "City or Lessor", and Tabby's Coffee, LLC, hereinafter referred to as "Lessee". <br /> WITNESS <br /> 1. PREMISES. Lessor does hereby lease to Lessee, and Lessee does hereby lease from <br /> Lessor, approximately 1,320 square feet in the southeast entry area of the Everett Public Main <br /> Library, (hereinafter called"Premises"), being located at 2702 Hoyt Ave, Everett, Washington, <br /> 98201 and legally described as: <br /> Lots 28 thru 32, Block 623, Plat of Everett, according to the plat thereof recorded in Volume <br /> 3 of Plats, page 32, records of the Auditor, of the County of Snohomish, State of <br /> Washington. <br /> 2. TERM. The initial term of this lease shall commence on December 1, 2017, and end <br /> at midnight November 30, 2018. Any tenancy after the initial term shall be on a month to month <br /> basis. Except as otherwise provided in this Agreement, either party may terminate this <br /> agreement upon thirty (30) days written notification. <br /> 3. RENT. Lessee leases said Premises for said period and agrees to pay a monthly rental <br /> in the amount of$700.00 on or before the 10th day of each month during the term of this lease <br /> to: <br /> City Clerk <br /> City of Everett <br /> 2930 Wetmore <br /> Everett, WA 98201 <br /> or such other place as the Lessor may from time to time designate in writing. If any rent is, at <br /> any time, five (5) or more days past due, Lessee will be charged a late charge equal to ten(10) <br /> percent of the past due rental amount. All rent payments must be made without deduction or <br /> offset. <br /> 4. USE. Lessee may use and occupy said Premises for the purpose of coffee/espresso <br /> brewing and sales and sales of food products that are prepared either on or off site. Lessee <br /> agrees that during its use of the Premises and occupancy thereof, Lessee shall comply with the <br /> laws, rules and regulations of the governments of the United States, State of Washington, <br /> Snohomish County, and City of Everett. Lessee agrees to maintain the Premises in good <br /> condition and repair throughout the term of the lease. Upon termination of the lease, Lessee <br /> shall quit and surrender the Premises in as good a state and condition as reasonable use and wear <br /> and tear thereof permit. Except for any damage caused by Lessee or its employees, agents, <br /> customers or invitees, which shall be restored by Lessee to as good a state and condition as <br /> existed before such damage occurred. Also, Lessor and Lessee's responsibilities regarding the <br /> use of the Premises shall be in accordance with the conditions listed in Exhibit A attached hereto <br /> and made a part of this agreement. In the event of any conflict between the lease terms or the <br /> conditions of attached Exhibit A, the more restrictive shall apply. <br />
