For the purposes of this section, "marijuana" means: <br /> a. all parts of the plant of the genus Cannibis L., whether growing or <br /> not; the seeds thereof; the resin extracted from any part of the plant; <br /> and every compound, manufacture, salt, derivative, mixture or <br /> preparation of the plant, its seeds or resin. <br /> 2. The offense of possession of marijuana is committed when a person <br /> knowingly possesses marijuana of a quantity of forty (40) grams or less. <br /> 3. It shall be an affirmative defense to the offense of possession of marijuana <br /> that such possession was lawful under ordinances of the City of Everett or <br /> laws of the State of Washington. <br /> 4. Possession of marijuana is a misdemeanor, and shall be punished by a fine <br /> not to exceed one thousand dollars ($1,000). <br /> -111- <br />
