NM OM MN I I 111111 MI M IIIIII I IIIIII OM M = <br /> Section 116: Possession or Consumption in Park and Recreation Buildings or Other <br /> Approved Areas <br /> Upon the conditions hereafter specified, it is lawful to open a package containing <br /> liquor, to possess or display an open container of liquor or to consume liquor in <br /> those parks and recreation buildings or structures or other approved enclosed and <br /> restricted areas as specified by resolution of the City Council. The persons using <br /> such premises for the purpose of opening a package containing liquor, possessing or <br /> displaying an open container of liquor and/or consuming liquor must obtain a <br /> banquet and rental permit from the Superintendent of Park and Recreation of the <br /> City or his designee at the park and recreation offices. Such banquet and rental <br /> permit shall be issued on the following conditions: <br /> A. The applicant must produce evidence that it has a banquet permit from the <br /> Washington State Liquor Control Board; <br /> B. The applicant deposit a sum of one hundred dollars ($100) to insure proper <br /> performance of cleanup by the applicant subsequent to the event for which <br /> the banquet and rental permit is issued; <br /> C. The applicant must affirm in writing that the attendance at the function for <br /> which the banquet and rental permit is issued is not pursuant to a general <br /> invitation to the public but pursuant to invitations either to specifically <br /> named persons or to actual members of the applicant's organization; <br /> provided, that the City Council may waive this requirement by resolution <br /> upon a showing by the applicant that special circumstances exist which <br /> would merit such waiver, and that adequate provisions have been made to <br /> accommodate the anticipated number of persons who would attend the <br /> function for which the banquet and rental permit is issued. <br /> D. The applicant agrees that he or she will save the City harmless from all <br /> losses or damages occasioned to him or her or to any third person or <br /> property by reason of any acts or omissions of the applicant or anyone using <br /> the premises pursuant to the banquet and rental permit, and he or she shall, <br /> after reasonable notice thereof, defend and pay the expense of any suit <br /> which may be commenced against the City by any third person alleging <br /> injury or loss by reason of such acts. <br /> -123- <br />
