<br /> Section 124: Destruction or Failure to Return Library Materials
<br /> 1. It is unlawful to intentionally injure, deface, cut or mark, or destroy any
<br /> property belonging in or on deposit with the Everett Public Library, or any
<br /> branch, reading room, deposit station, museum, or institution operated in
<br /> connection therewith.
<br /> 2. It is unlawful to retain any book, newspaper, magazine, pamphlet, document,
<br /> record, film, print, manuscript, or other property belonging to or in, or on
<br /> deposit with, the Everett Public Library, or any branch, reading room,
<br /> deposit station, museum, or institution operated in connection therewith, for
<br /> a period exceeding thirty days after the mailing by certified mail to the
<br /> borrower's address on file with said library of a notice in writing to return
<br /> the same. Such notice shall be given after the expiration of time which, by
<br /> the rules of the Everett Public Library, such article or other property may
<br /> be kept. If such library materials are not returned after the date indicated
<br /> on the notice, the borrower shall be billed for the purchase price of the
<br /> materials, regardless of whether the materials are returned after the final
<br /> return date. Such notice so mailed shall bear on its face a copy of this
<br /> section.
<br /> 3. It is the responsibility of the person to whom a library card was issued
<br /> whenever that card is used to check out any item from the library; provided,
<br /> however, such person is relieved from further responsibility, upon notifica-
<br /> tion to the Everett Public Library that the library card has been lost,
<br /> misplaced or otherwise unaccountable. It shall be the duty of any person to
<br /> whom a library card is issued to notify the Everett Public Library of any
<br /> change of address.
<br /> 4. It is unlawful to take from the Everett Public Library, or any branch,
<br /> reading room, deposit station, museum, or institution operated in connection
<br /> therewith, any property belonging therein or thereto, without the permission
<br /> of the librarian or an assistant, or by making use of a borrower's card
<br /> belonging to another without the permission of the owner thereof and the
<br /> librarian or an assistant, or by color or aid of any fraud or false representa-
<br /> tion, impersonation or pretense, or by any false token writing, or by any
<br /> device or trick.
<br /> 5. Any person convicted of any provision of this section shall be guilty of a
<br /> misdemeanor, and may be punished by a fine not to exceed one thousand
<br /> dollars ($1,000).
