• <br /> 1 ORDINANCE N0./(a co - 9 <br /> 2 AN ORDINANCE relating to the supplying of industrial <br /> 3 (non-filtered) water and establishing rates and charges for <br /> connection to industrial water supply facilities and <br /> 4 service therefrom. <br /> 5 WHEREAS, the City Council of the City of Everett has authorized two <br /> 6 agreements between the City and Scott Paper Company (Scott) regarding the <br /> 7 supplying of industrial water to Scott: the 1957 Water Contract, as amended, <br /> 8 and the April 12, 1983, Industrial Water System Separation Agreement <br /> 9 <br /> (Separation Agreement) ; and <br /> 10 WHEREAS, under said agreements certain facilities of the Everett Water <br /> 11 System have been dedicated for supplying industrial water to Scott Paper <br /> 12 <br /> Company; and <br /> P <br /> 13 WHEREAS, the City Council hereby desires to establish terms and <br /> 14 conditions under which other customers may utilize said industrial water <br /> 15 supply facilities ; <br /> 16 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 17 1 . Definitions. <br /> 18 A. "Industrial water" shall mean water which is untreated or <br /> 19 otherwise unsuitable as a source of supply for a public water system under <br /> 20 the rules of the State Board of Health. (WAC 248-54) <br /> 21 B. "Scott" shall mean Scott Paper Company. <br /> 22 C. "Latecomer" shall mean any person other than Scott who shall <br /> 23 <br /> apply for industrial water. <br /> 24 <br /> 2. Everett water system facilities dedicated for industrial water <br /> 25 service shall not exceed 50 MGD peak capacity of which Scott's current <br /> 26 demand is 40 MGD. All connections to the industrial water supply shall be <br /> 27 <br /> subject to approval of Scott Paper Company. Delivery of industrial water <br /> 28 <br /> shall be subject to rules and regulations established by the Utilities <br /> 29 <br /> Superintendent. <br /> 30 <br /> 3. All applications for industrial water shall be subject to <br /> 31 <br /> approval by the Utilities Superintendent who shall disapprove any <br /> 32 <br /> application which will violate state domestic water supply regulations. <br />
