ORDINANCE NO. /.5 . - <br /> An Ordinance amending the Zoning Map of the <br /> City of Everett as provided by Ordinance No. 3572 <br /> as amended (Title 19, Everett Municipal Code), <br /> rezoning the area generally described as <br /> Seaway Center Development Reserve area, Lot #6 <br /> situated north of Merrill Creek Parkway and <br /> east of Merrill and Ring Creek, from <br /> M-1, Heavy Manufacturing to <br /> C-2, Heavy Commercial-Light Industrial <br /> with a concomitant agreement. <br /> WHEREAS, on October 7, 1988 the City of Everett received an <br /> application for a Comprehensive General Plan amendment and rezone of an area <br /> generally described as Seaway Center - Development Reserve area, Lot 6 <br /> situated north of Merrill Creek Parkway, east of Merrill and Ring Creek, <br /> requesting a change in the Comprehensive General Plan from Multiple Family <br /> Residential, 10-15 dwelling units per gross acre to Office and Industrial <br /> Park (OIP), and a change in the zoning from Heavy Heavy Manufacturing to C-2, <br /> Heavy Commercial-Light Industrial with concomitant agreement; and <br /> WHEREAS, on February 14, 1989, and March 28, 1989, the Everett <br /> Planning Commission held a public meetiicg--nd public hearing on the proposed <br /> Comprehensive General Plan amendment and rezone; and <br /> WHEREAS, based upon the findings contained in the Planning Commission <br /> Report to City Council dated April 12, 1989, attached hereto as Exhibit 3 <br /> and incorporated herein by reference, the Planning Commission did recommend <br /> approval of an amendment and rezone; and <br /> WHEREAS, the proposed zoning is consistent with the Comprehensive <br /> General Plan Amendment approved by City Council on April 19, 1989, and is in <br /> the best interests of the health, safety, and general welfare of the <br /> citizens of Everett; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the City Council does hereby find that the zoning <br /> change hereinafter set forth for the property legally described and <br /> generally shown on the map in Exhibit 1, attached hereto and incorporated <br /> herein by reference, bears a substantial relationship to the general welfare <br /> of the City of Everett and is in conformance with the Comprehensive General <br /> Plan as amended. <br /> Section 2: That the proposed zoning change is subject to the <br /> conditions of the C-2 Heavy Commercial-Light Industrial zone and the <br /> conditions stated in the concomitant agreement, which is attached hereto as <br /> Exhibit 2 and incorporated herein by reference, said agreement shall be <br /> signed by all parties of record of the subject property and shall be binding <br /> upon them, their heirs, successors, assigns and tenants. <br /> Section 3: That the filing of the proposed zoning change with the <br /> Snohomish County Auditor is subject to all of the owners of record of the <br /> subject property signing the attached concomitant agreement within thirty <br />
