• • Section 6: Severability. If any provision of this ordinance shall be declared unconstitutional or invalid by any court of competent jurisdiction, it shall be conclusively presumed that this ordinance would have been enacted without the provision so held unconstitutional or invalid and the remainder of this ordinance shall not be affected as a result of said part being unconstitutional or invalid. BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: Section 1: A special construction fund is hereby established as Fund 391, entitled "Hewitt, Oakes, and Lombard Bridge Replacement" to accumulate the design and construction costs required to design and construct the Hewitt, Oakes, and Lombard Bridge Replacements including bridge approaches, street lighting, utilities, and other necessary improvements. Section 2: Authorization is hereby given to transfer the preliminary engineering funds from the existing "Traffic Engineering Improvements", Fund 368, Programs 291, 297, and 298 to the new Fund 391, Programs 924, 925, and 926, "Hewitt, Oakes, and Lombard Bridge Replacement". Section 3: Authorization is hereby given to accumulate costs and distribute payments from Fund 391 for design and construction of the Hewitt, Oakes, and Lombard Bridge Replacements including bridge approaches, street lighting, utilities, and other necessary improvements. Section 4: Authorization is hereby granted for the "Public Works Director", under the direction of the Mayor, to assume full and complete responsibility for conducting all tasks and doing all things to accomplish the actions authorized in this ordinance. The Mayor is authorized to execute updated City/County Agreements, as necessary, for each bridge with WSDOT to accomplish Federal Project Funding. Section 5: The sum $2,618,168 is hereby appropriated to Fund 391, "Hewitt, Oakes, and Lombard Bridge Replacements" as follows: -6-
