/ Cj . <br /> 1 ORDINANCE NO. /_lpf�''c/ <br /> 2 <br /> AN ORDINANCE establishing compensation to the City for <br /> 3 right-of-way acquisition costs and design costs. <br /> 4 <br /> 5 WHEREAS, although the City of Everett frequently acquires property for <br /> 6 right-of-way by dedication or other means without payment of compensation, <br /> 7 there are occasions when the City has paid compensation for parcels of <br /> 8 property or portions thereof which are available for right-of-way <br /> 9 improvement and the City Council hereby finds that right-of-way improvement <br /> 10 permits should include reimbursement to the City for the cost of <br /> 11 right-of-way acquisition in addition to current right-of-way permit fees; and <br /> 12 WHEREAS, the City has incurred costs to prepare plans and <br /> 13 specifications for right-of-way improvements, particularly under the <br /> 14 now-void 16th Street LID, which the City Council finds are proprietary and <br /> 15 for the use of which the City should be compensated; <br /> 16 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 17 Section 1 : That, in addition to the current fees charged for Public <br /> 18 Works permits granted by the City for right-of-way improvements, the Public <br /> 19 Works Director shall charge a square footage fee based on the acquisition <br /> 20 cost after the effective date of this ordinance of any City property to be <br /> 21 improved under the permit, provided that said square footage fee shall not <br /> 22 be charged for improvement of any property dedicated to the City without <br /> 23 cost or compensation. "Acquisition cost" for purposes of this ordinance <br /> 24 shall be determined by the City's original cost of acquisition (or prorated <br /> 25 to the square footage permitted) plus .1% per month COL adjustment. <br /> 26 Section 2: That all monies derived from the square footage fee shall <br /> 27 be deposited in Fund 145, "Real Property Acquisition Fund." Except when the <br /> 28 acquisition was from a utility fund whereby the monies will be deposited in <br /> 29 the acquiring fund. <br /> 30 Section 3: The Public Works Director shall not release any plans or <br /> 31 engineering data developed under LID 727, except upon payment to the City of <br /> 32 <br />
