• <br /> 1 "needle tracks"; or a person who possesses drug <br /> paraphernalia as defined in Chapter 5.112 of the Everett <br /> 2 Municipal Code; <br /> b. Such person is currently subject to an order prohibiting <br /> 3 his/her presence in a high drug activity geographic area; <br /> c. Such person behaves in such a manner as to raise a <br /> 4 reasonable suspicion that he or she is about to engage in <br /> or is then engaged in an unlawful drug-related activity, <br /> 5 including by way of example only, such person acting as a <br /> "lookout"; <br /> 6 d. Such person is physically identified by the officer as a <br /> member of a "gang", or association which has as its purpose <br /> 7 illegal drug activity; <br /> e. Such person transfers small objects or packages for <br /> 8 currency in a furtive fashion; <br /> f. Such person takes flight upon the appearance of a police <br /> 9 officer; <br /> g. Such person manifestly endeavors to conceal himself or <br /> 10 herself or any object which reasonably could be involved in <br /> an unlawful drug-related activity; <br /> 11 h. The area involved is by public repute known to be an area <br /> of unlawful drug use and trafficking; <br /> 12 i • The premises involved are known to have been reported to <br /> law enforcement as a place suspected of drug activity <br /> 13 pursuant to Chapter 69.52 of the Revised Code of <br /> Washington; and <br /> 14 j . Any vehicle involved is registered to a known unlawful drug <br /> user, possessor, or seller, or a person for whom there is <br /> 15 an outstanding warrant for a crime involving drug-related <br /> activity. <br /> 16 <br /> 17 Section 3: PENALTY. <br /> 18 Any person who violates the provisions of this Chapter is guilty of a <br /> 19 gross misdemeanor. <br /> 20 Section 4: SEVERABILITY. <br /> 21 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 22 of this Ordinance or its application to any person or situation be declared <br /> 23 unconstitutional or invalid for any reason, such decision shall not affect <br /> 24 the validity of the remaining portions of this Ordinance or its application <br /> 25 to any other person or situation. The City Council of the City of Everett <br /> 26 hereby declares that it would have adopted this Ordinance and each section, <br /> 27 subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> 28 fact that any one or more sections, subsections, sentences, clauses, phrases <br /> 29 or portions be declared invalid or unconstitutional . <br /> 30 <br /> 31 <br /> 32 <br /> 2 <br />
