ALSO that portion of said Plat of Sound View Addition to the City of Everett, described as follows: Commencing at the Southwest corner of said plat; thence North 88°49'19" East, along the South line thereof, for 148.93 feet to the true point of beginning; thence North 26°57'18" East for 186.57 feet to the Northeasterly line of Lot 10 of said Plat of Sound View Addition to the City of Everett; thence South 20000'38" East, along said line of Lot 10, for 13.68 feet to a corner common with Lots 3, 10, and 11 of said plat; thence South 26°57'18" West, along the Southeast line of Lot 11 of said plat and the Southerly projection, for 171.88 feet to the South line of said plat; thence South 88°49'19" West, along said South line, for 11.34 feet to the true point of beginning. EXCEPT any portion within Elma Street, according to said plat. This ordinance shall not become effective until the owners/petitioner/proponent have executed and delivered said deed to the City of Everett as required herein. Section 4: That this ordinance shall not become effective until the owners of the property abutting upon the street herein described have compensated the City of Everett in an amount equal to one-half the current appraised value of the difference of (1) the area vacated and (2) the area dedicated. The abutting property owners shall have ninety (90) days following passage of this ordinance to exercise this vacation. Unless otherwise amended by City Council, this ordinance shall be null and void if the abutting property owner(s) fail to exercise this vacation within ninety (90) days following passage of this ordinance. -3-
