ALSO that portion of said Plat of Sound View Addition to the City of <br /> Everett, described as follows: <br /> Commencing at the Southwest corner of said plat; thence North 88°49'19" <br /> East, along the South line thereof, for 148.93 feet to the true point of <br /> beginning; thence North 26°57'18" East for 186.57 feet to the <br /> Northeasterly line of Lot 10 of said Plat of Sound View Addition to the <br /> City of Everett; thence South 20000'38" East, along said line of Lot <br /> 10, for 13.68 feet to a corner common with Lots 3, 10, and 11 of said <br /> plat; thence South 26°57'18" West, along the Southeast line of Lot 11 <br /> of said plat and the Southerly projection, for 171.88 feet to the South <br /> line of said plat; thence South 88°49'19" West, along said South line, <br /> for 11.34 feet to the true point of beginning. <br /> EXCEPT any portion within Elma Street, according to said plat. <br /> This ordinance shall not become effective until the <br /> owners/petitioner/proponent have executed and delivered said deed to the <br /> City of Everett as required herein. <br /> Section 4: That this ordinance shall not become effective until the <br /> owners of the property abutting upon the street herein described have <br /> compensated the City of Everett in an amount equal to one-half the <br /> current appraised value of the difference of (1) the area vacated and (2) <br /> the area dedicated. The abutting property owners shall have ninety (90) <br /> days following passage of this ordinance to exercise this vacation. <br /> Unless otherwise amended by City Council, this ordinance shall be null <br /> and void if the abutting property owner(s) fail to exercise this vacation <br /> within ninety (90) days following passage of this ordinance. <br /> -3- <br />
