f • ORDINANCE NO. /158= 1 2 AN ORDINANCE amending Section 8 of Ordinance No. 1454-88, City' s 3 Dance Hall Ordinance and repealing Section 3 of Ordinance No. 1488-88. 4 5 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1 : That Section 8 of Ordinance No. 1454-88 as amended by 7 Section 3 of Ordinance No. 1488-88 reads as follows: 8 9 Section 8: REQUIREMENTS OF OPERATION - AGE - RESTRICTIONS - PENALTY. 10 11 A. No person conducting or operating a teen dance or person maintaining a teen dance hall shall permit, either by act or 12 omission, persons under the age of sixteen (16) to enter or remain on the premises without a parent or legal guardian present 13 or persons over the age of twenty (20) to enter or remain on the premises except a parent or legal guardian accompanying a person 14 under the age of twenty (20) years, and except bona fide employees of the person conducting or operating such teen dance or teen dance hall . 15 16 B. No person conducting or operating a public dance or public dance hall shall allow persons over the age of twenty (20) to 17 enter or remain on the premises, except for bona fide employees of the person operating or conducting such public dance or public 18 dance hall and parents or guardians accompanying a person when persons under the age of twenty-one (21 ) are present. 19 C. Every person who knowingly or recklessly shall allow a 20 person to enter or remain in violation of this section shall be guilty of a misdemeanor. It is the responsibility of the person 21 conducting and/or operating a public dance to require picture identification showing the age of each person admitted. 22 D. Any person who shall by affirmative misrepresentation of 23 age obtain admission to or permission to remain in any teen dance or public dance in violation of this Chapter shall be guilty of a 24 misdemeanor. 25 E. No public dance shall be conducted past the hour of 2:00 a.m. ; Provided, however, no teen dance shall be conducted past 26 the hour of 1 :30 a.m. 27 F. It shall be the obligation of every person licensed under this Chapter to ensure that an adequate number of qualified 28 security personnel as approved by the Police Department are employed and present at public dances, during and following each 29 dance, as is necessary to maintain order and ensure compliance with the provisions of this Chapter as well as the laws of the 30 state of Washington and ordinances of the City of Everett. 31 32
