Other uses not listed above if determined through the review process to be compatible <br /> with surrounding properties and the immediate vicinity. <br /> 5. Review Criteria. The following criteria shall be used as the basis for determining <br /> compatibility with surrounding uses and approving, denying, or conditionally approving a <br /> request to allow the adaptive reuse of a non-residential building in a residential zone: <br /> a. General evaluation criteria of 41.150.C. <br /> b. The adaptive reuse would promote or aid in the preservation or rehabilitation of the <br /> primary building. <br /> c. No significant adverse impacts to public safety. <br /> d. Compliance with building and fire codes. <br /> e. Hours of the day of proposed use or activity. <br /> f. Proposed management and operational procedures to minimize and mitigate potential <br /> impacts. <br /> g. Expansions to the primary building shall not exceed 10%of the existing footprint or 500 <br /> square feet, whichever is greater, and will not detrimentally affect the outside character of <br /> the building. <br /> h. Other factors not specified herein that would create adverse impacts to the immediate <br /> vicinity. <br /> 6. Any proposal that would adversely affect properties in the immediate vicinity shall be <br /> denied. The city shall retain the right to revoke a permit issued under this section that fails to <br /> comply with any conditions of approval of said permit, or which operates in a manner <br /> inconsistent with representations made in the application,pursuant to EMC Title 1 Chapter 1.20. <br /> F. Notification.Notification for special property use applications shall be provided according <br /> to the required review process, as specified in Title 15, Local Project Review Procedures. <br /> G. Review Authority Decisions. <br /> 1. Conditions and Restrictions. If the review authority approves a special property use <br /> permit, conditions and restrictions may be applied thereto, which exceed the minimum <br /> standards required by this title, when necessary to assure that the proposed use complies <br /> with all requirements of this title and is compatible with surrounding land uses. <br /> 2. Time Limit on Approval. The effective time period in which the applicant may establish <br /> the use proposed by an approved special property use permit shall be five years from the <br /> date of the written order granting approval of the permit. The written order may specify a <br /> shorter time period if the review authority determines that it is in the public interest to <br /> authorize a shorter period of time in which to establish the use.
