Amendment No. 1 clarifies this by <br /> replacing Section 9.4 to read as follows: <br /> "The Property is not subject to any leases or service contracts that will be in effect after the Closing Date, <br /> with the sole exception of that certain lease between the Seller and United States of America as tenant dated <br /> December 7,2011. On or before the Closing Date,the Seller will deposit into escrow an estoppel certificate <br /> in a form reasonably acceptable to the Buyer fully executed by such tenant. Buyer has no obligation to close <br /> unless such certificate is so delivered." <br /> RECOMMENDATION(Exact action requested of Council): <br /> Authorize Mayor to sign Amendment No. 1 to the real estate purchase and sale agreement with Snohomish <br /> County Health District in substantially the form provided for the property located at 3020 Rucker Avenue. <br /> 35 <br />
