ii <br /> • - ' ORDINANCE NO. 16-3' iFF ' <br /> ji <br /> AN ORDINANCE providing for the vacation of <br /> an Unnamed Right of Way lying South of Lake Heights Drive. <br /> WHEREAS, the City Council of the City of Everett, did by Resolution <br /> 1 No. 2781, duly adopt and fix the 5th day of December, 1986, at 8:30 a.m. , as <br /> 1 the date for public hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and <br /> determination of said resolution has been given by the City Clerk in the <br /> ; manner prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, favorable statements <br /> and objections to the vacating of the herein described street were heard and <br /> discussed; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that <br /> lithe said street resolved to be vacated should be vacated pursuant to the terms <br /> and conditions of this ordinance; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the following described right-of-way: <br /> All that portion of an unnamed right of way lying South of <br /> Lake Heights Drive in the Northwest quarter of Section 29, <br /> Township 28 North, Range 5 East, W.M. ; described as follows: <br /> BEGINNING at the Northeast corner of Lot 2, Plat of Hansen's <br /> Silver Lake Heights, according to the plat thereof, recorded <br /> in Volume 23 of Plats, Page 25, Records of Snohomish County, <br /> Washington; THENCE Northeasterly along the Northeasterly <br /> projected Southerly right of way line of Lake Heights Drive <br /> to the Northeast corner of Lot 3 of said Plat; THENCE, <br /> Southwesterly along the Westerly line of said Lot 3, which <br /> line is also the easterly line of said unnamed right of way, <br /> to the Southwest corner of said Lot 3; THENCE, Southwesterly <br /> to the Southeast corner of Lot 2 of said Plat; THENCE, <br /> Northeasterly along the Easterly line of said Lot 2, which <br /> line is also the Westerly line of said unnamed right of way, <br /> to the POINT OF BEGINNING. <br /> ibe and the same is hereby vacated pursuant to the conditions set forth in this <br /> 1 ordinance. <br /> Section 2: That the City of Everett shall not be responsible nor <br /> liable for storm drainage runoff resulting from existing drainage patterns as <br /> established on City rights-of-way that may currently, or in the future, go <br /> over, under or across the above described street vacation. <br /> -1- <br />
