1 storage fees charged were in compliance with the posted <br /> rates, and who is responsible for payment of the fees. <br /> 2 <br /> 6. If the impoundment is found proper, the impoundment, <br /> 3 towing, and storage fees as permitted together with any <br /> administrative costs shall be assessed against the person <br /> 4 or persons requesting the hearing, unless the operator did <br /> not have a signed and valid impoundment authorization from <br /> 5 a private property owner or an authorized agent. <br /> 6 7. If the impoundment is determined to be invalid, then the <br /> registered and legal owners of the vehicle shall bear no <br /> 7 impoundment, towing, or storage fees, and any bond or other <br /> security shall be returned or discharged as appropriate, <br /> 8 and the person or agency who authorized the impoundment <br /> shall be liable for any towing, storage, or other <br /> 9 impoundment fees permitted. <br /> 10 8. The decision of the Mayor shall be final unless an appeal <br /> is filed with the Everett District Court within fifteen <br /> 11 (15) days of the date of the determination made by the <br /> Mayor. <br /> 12 <br /> 13 Section 2: Severability. <br /> 14 If any provision of this ordinance shall be declared unconstitutional <br /> 15 or invalid by any court of competent jurisdiction, it shall be conclusively <br /> 16 presumed that this ordinance would have been enacted without the provision <br /> 17 so held unconstitutional or invalid and the remainder of this ordinance <br /> 18 shall not be affected as a result of said part being held unconstitutional <br /> 19 or invalid. <br /> 20 Section 3: Purpose. <br /> 21 It is expressly the purpose of this ordinance to provide for and <br /> 22 promote the health, safety and welfare of the general public, and not to <br /> 23 create or otherwise establish or designate any particular class or group of <br /> 24 persons who will or should be especially protected or benefitted by the <br /> 25 terms of this ordinance. <br /> 26 It is the specific intent of this ordinance that no provision nor any <br /> 27 term used in this ordinance is intended to impose any duty whatsoever upon <br /> 28 the City or any of its officers or employees, for whom the implementation or <br /> 29 enforcement of this ordinance shall be discretionary and not mandatory. <br /> 30 Nothing contained in this ordinance is intended to be nor shall be <br /> 31 construed to create or form the basis for any liability on the part of the <br /> 32 <br /> 4 <br />
