i 1 ORDINANCE NO. 2 AN ORDINANCE amending of the City's Parking Ordinance, Ordinance 3 No. 994-83 (EMC 46.28) to establish a repeat violator and a waiver provision. 4 5 WHEREAS, the City Council finds that the orderly movement of vehicles 6 in and out of parking spaces and assurance of regular turnover of access to parking spots to as large a number of persons as circumstances permit is an 7 important part of traffic regulation on the City's streets; and 8 WHEREAS, the City Council finds that the existing City parking 9 regulations do not assure the regular turnover of access to parking spots needed in the downtown area; and 10 WHEREAS, the City Council finds that the existing parking regulations 11 result in numerous repeat offenders who further frustrate the regular 12 turnover of access to parking spots; and WHEREAS, the City Council finds that changes must be made to the City's 13 parking regulations to address this problem; and 14 WHEREAS, the City Council finds that in order to help attract visitors 15 and conventions to the City, that it is appropriate and in the best interest of the citizens of Everett to provide limited administrative waivers of 16 certain requirements and fees; 17 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 18 Section 1 : That Section 26 of Ordinance No. 994-83 as amended by Ordinance No. 1510-88 (EMC46.28.26O) which reads as follows: 19 20 Penalties. 21 A. Unless specifically set forth elsewhere in this Ordinance, the penalties for each parking violation of the provisions 22 of this Ordinance shall be: 23 1 . Overtime Parking: Ten Dollars ($10.00) ; 24 2. Unauthorized Parking in Alley: Ten Dollars ($10.00) ; 25 3. Parking in Disabled Space Without Requisite Permit, Decal , or License: Twenty-Five Dollars ($25.00) ; 26 4. Parking, Stopping, or Standing in Fire Lane in 27 Violation of Section 13 of this Ordinance: Twenty-Five Dollars ($25.00) ; 28 5. Interfering with, concealing, obliterating or erasing 29 marks: Twenty-Five Dollars ($25.00) ; 30 6. All Other Violations: Ten Dollars ($10.00) ; 31 B. If no response or payment be made within ten (10) calendar days of the date of issuance of the notice of parking 32 violation, the penalty for each violation shall be:
