CITY <br /> LEASE AMENDMENT NO. 1 <br /> THIS AMENDMENT ("Amendment") is dated for reference purposes October 1, <br /> 2017, by and between the CITY OF EVERETT (the "City") and HCR LLC, a Washington <br /> limited liability company and owner of Forest View Transitional Health (formerly Pleasant <br /> Acres) ("Tenant"). This Amendment No. 1 concerns the lease between Tenant and the City <br /> dated October 1, 2012 (the "Lease"). The parties desire to renew the Lease and revise the <br /> option provisions of the Lease. <br /> Accordingly, the parties agree as follows: <br /> 1. Extension. The parties agree to exercise Option 2 of the lease extending it five <br /> (5) years so that it expires on September 30, 2022. <br /> 2. Full Force and Effect. The parties agree that the Lease remains in full force <br /> and effect without interruption, except as expressly modified by this Amendment. As of the <br /> Effective Date, the parties know of no facts or circumstances that would constitute a default <br /> under the Lease. <br /> 3. Effective Date. The Effective Date of this Amendment is October 1, 2017, <br /> regardless of the date of signatures on this Amendment. <br /> 4.
