1 ORDINANCE NO. /�'D7— BP 2 AN ORDINANCE condemning certain property as herein described on 3 the Old Interurban right-of-way from Everett Mall Way 1900 feet north for a standard two lane street with left turn 4 lanes and sidewalks. 5 WHEREAS, the City Council of the City of Everett finds as follows: 6 1 . That the City of Everett has created LID 728 for the construction of a standard two lane street on the Old Interurban right-of-way from 8 9 Everett Mall Way, 1900 feet north (as legally described in Exhibit A 10 attached hereto and incorporated herein by reference) . 2. That said street is necessary to access certain properties (i .e. 11 12 "1201 Assoc. ," "Lloyd Solie" and "Cypress Lawn Memorial , Inc." ) to the north 13 of Everett Mall Way as shown on Exhibit B attached hereto and incorporated 14 herein by reference and to improve access to the other properties shown on Exhibit B. 15 16 3. That the Old Interurban right-of-way is a 70 foot wide corridor 17 which has been discontinued from use as a railway and the rights of the 18 Pacific Northwest Traction Co. have been quit claimed to the Public Utility 19 District No. 1 of Snohomish County which presently uses a portion of the 20 property for electrical power transmission lines. Said right-of-way is 21 sufficient for both street and electrical utility use. 22 4. The City needs a strip 35 feet wide of the 70 foot width of said 23 Old Interurban right-of-way for street use. An additional 7 feet would be 24 required if the City were to allow overhead electrical and telephone lines 25 on the street right-of-way. The City Attorney is authorized to modify the 26 legal description of the property taken herein as necessary for street needs 27 or to expand the width to accommodate overhead electrical and telephone 28 communication use. 29 5. The public interests of the City of Everett require that the 30 property described in Exhibit A be acquired for permanent public use for 31 streets, sidewalks and utilities, including drainage, water and sewer lines 32 for the citizens of the City of Everett and adjacent areas.
