1 ORDINANCE NO. /�'D7— BP <br /> 2 <br /> AN ORDINANCE condemning certain property as herein described on <br /> 3 <br /> the Old Interurban right-of-way from Everett Mall Way 1900 <br /> feet north for a standard two lane street with left turn <br /> 4 lanes and sidewalks. <br /> 5 <br /> WHEREAS, the City Council of the City of Everett finds as follows: <br /> 6 <br /> 1 . That the City of Everett has created LID 728 for the construction <br /> of a standard two lane street on the Old Interurban right-of-way from <br /> 8 <br /> 9 Everett Mall Way, 1900 feet north (as legally described in Exhibit A <br /> 10 attached hereto and incorporated herein by reference) . <br /> 2. That said street is necessary to access certain properties (i .e. <br /> 11 <br /> 12 "1201 Assoc. ," "Lloyd Solie" and "Cypress Lawn Memorial , Inc." ) to the north <br /> 13 of Everett Mall Way as shown on Exhibit B attached hereto and incorporated <br /> 14 herein by reference and to improve access to the other properties shown on <br /> Exhibit B. <br /> 15 <br /> 16 3. That the Old Interurban right-of-way is a 70 foot wide corridor <br /> 17 which has been discontinued from use as a railway and the rights of the <br /> 18 Pacific Northwest Traction Co. have been quit claimed to the Public Utility <br /> 19 District No. 1 of Snohomish County which presently uses a portion of the <br /> 20 property for electrical power transmission lines. Said right-of-way is <br /> 21 sufficient for both street and electrical utility use. <br /> 22 4. The City needs a strip 35 feet wide of the 70 foot width of said <br /> 23 Old Interurban right-of-way for street use. An additional 7 feet would be <br /> 24 required if the City were to allow overhead electrical and telephone lines <br /> 25 on the street right-of-way. The City Attorney is authorized to modify the <br /> 26 legal description of the property taken herein as necessary for street needs <br /> 27 or to expand the width to accommodate overhead electrical and telephone <br /> 28 communication use. <br /> 29 5. The public interests of the City of Everett require that the <br /> 30 property described in Exhibit A be acquired for permanent public use for <br /> 31 streets, sidewalks and utilities, including drainage, water and sewer lines <br /> 32 for the citizens of the City of Everett and adjacent areas. <br />
