• <br /> ORDINANCE NO. /i9?— <br /> AN <br /> — <br /> AN ORDINANCE creating a special construction <br /> fund entitled "Silver Lake Construction" <br /> Fund 334, Authorizing the design and <br /> construction of improvements at Silver Lake Park. <br /> WHEREAS, the City of Everett Parks and Recreation Department developed a <br /> Capital Improvement Program outlining the recreational needs of the City of <br /> Everett; and <br /> WHEREAS, a need exists to provide a public swimming beach, rental <br /> facilities and miscellaneous park ammenities for the citizens of Everett; and <br /> WHEREAS, the Everett City Council approved a revenue funding source for <br /> CIP projects: <br /> WHEREAS, Silver Lake Park has been designated for improvements to the <br /> existing swimming beach and other park facilities: <br /> NOW, THEREFORE, BE IT ORDAINED BY THE EVERETT CITY COUNCIL THAT: <br /> Section 1: A special construction fund is hereby established as Fund 344, <br /> entitled "Silver Lake Park Construction" to accomplish the <br /> actions authorized in subsequent sections of this ordinance. <br /> Section 2: Authorization is hereby granted to the Director of Parks and <br /> Recreation under the administration of the Mayor to design and <br /> construct improvements to Silver Lake Park including <br /> modifications to the existing swimming beach area, playground, <br /> parking and other miscellaneous site improvements as determined <br /> by the Director of Parks and Recreation. <br /> Section 3: The total estimated cost of the improvements authorized is <br /> $1,550,025 which shall include all costs related to design, <br /> construction, contract administration, plan development and <br /> associated costs. <br /> Section 4: A. The sum of $1,550,025 is hereby appropriated to Fund 344 <br /> Program 954 "Silver Lake Park Construction". <br /> B. Source of Funds: <br /> 1. CIP Revenue <br /> Section 5: This appropriation shall not lapse but shall be carried forward <br /> year to year until fully expended or the purpose has been <br /> accomplished or abandoned without the necessity of <br /> reappropriation as per RCW 35.33.151. <br /> SEVERABILITY <br /> If any provision of this Ordinance should be declared unconstitutional or <br /> invalid by any court of competent jurisdiction, it should be conclusively <br /> presumed that this Ordinance would have been inacted without the provision so <br /> held unconstitutional or invalid and the remainder of this Ordinance should <br /> not be affected as a result of said part being held unconstitutional or <br /> invalid. <br /> CI OF EVERETT <br /> AY/ <br /> WILLIAM E.
