ORDINANCE NO. //g925-5.(i <br /> AN ORDINANCE creating a special construction <br /> fund entitled "Forest Park Construction" <br /> Fund 345, Authorizing the design and <br /> construction of improvements at Forest Park. <br /> WHEREAS, the City of Everett Parks and Recreation Department developed a <br /> Capital Improvement Program outlining the recreational needs of the City of <br /> Everett; and <br /> WHEREAS, a need exists to provide a Swim Center, rental facilities and <br /> miscellaneous park ammenities for the citizens of Everett; and <br /> WHEREAS, the Everett City Council approved a revenue funding source for <br /> CIP projects: <br /> WHEREAS, Forest Park has been designated for improvements to the existing <br /> Swim Center and other park facilities: <br /> NOW, THEREFORE, BE IT ORDAINED BY THE EVERETT CITY COUNCIL THAT: <br /> Section 1: A special construction fund is hereby established as Fund 345, <br /> entitled "Forest Park Construction" to accomplish the actions <br /> authorized in subsequent sections of this ordinance. <br /> Section 2: Authorization is hereby granted to the Director of Parks and <br /> Recreation under the administration of the Mayor to design and <br /> construct improvements to Forest Park including modifications to <br /> the existing Swim Center, playground, parking and other <br /> miscellaneous site improvements as determined by the Director of <br /> Parks and Recreation. <br /> Section 3: The total estimated cost of the improvements authorized is <br /> $2,337,400 which shall include all costs related to design, <br /> construction, contract administration, plan development and <br /> associated costs. <br /> Section 4: A. The sum of $2,337,400 is hereby appropriated to Fund 345 <br /> Program 955 "Forest Park Construction". <br /> B. Source of Funds: <br /> 1. CIP Revenue <br /> Section 5: This appropriation shall not lapse but shall be carried forward <br /> year to year until fully expended or the purpose has been <br /> accomplished or abandoned without the necessity of <br /> reappropriation as per RCW 35.33.151. <br /> SEVERABILITY <br /> If any provision of this Ordinance should be declared unconstitutional or <br /> invalid by any court of competent jurisdiction, it should be conclusively <br /> presumed that this Ordinance would have been inacted without the provision so <br /> held unconstitutional or invalid and the remainder of this Ordinance should <br /> not be affected as a result of said part being held unconstitutional or <br /> invalid. <br /> CITY F EVE' TT <br /> ` <br /> /' %Y _ <br /> WILLIAM E.
